第八条
A person who, at the time of enforcement of this Act, actually has received the Certification of Needed Long-Term Care prescribed in Article 19, paragraph (1) of the Former Long-Term Care Insurance Act or the Certification of Needed Support prescribed in paragraph (2) of that Article is deemed to have received, on the Effective Date, the Certification of Needed Long-Term Care prescribed in Article 19, paragraph (1) of the New Long-Term Care Insurance Act (hereinafter referred to as "New Certification of Needed Long-Term Care"). In this case, the Effective Period prescribed in Article 28, paragraph (1) of the Long-Term Care Insurance Act pertaining to a person deemed to have received said New Certification of Needed Long-Term Care is, notwithstanding that paragraph, to be the same period as the remaining period of the Effective Period prescribed in that paragraph pertaining to that person on the Effective Date, or of the Effective Period prescribed in Article 33, paragraph (1) of the Former Long-Term Care Insurance Act.
この法律の施行の際現に旧介護保険法第十九条第一項に規定する要介護認定又は同条第二項に規定する要支援認定を受けている者は、施行日に、新介護保険法第十九条第一項に規定する要介護認定（以下「新要介護認定」という。）を受けたものとみなす。この場合において、当該新要介護認定を受けたものとみなされた者に係る介護保険法第二十八条第一項に規定する有効期間は、同項の規定にかかわらず、施行日におけるその者に係る同項に規定する有効期間又は旧介護保険法第三十三条第一項に規定する有効期間の残存期間と同一の期間とする。
