The amount specified by Order of the Ministry of Health, Labour and Welfare as referred to in Article 14, paragraph (1) of the Act is the amount listed in the right column of Appended Table 4 corresponding to the basic daily benefit amount under Article 46-20, paragraph (1) of the Industrial Accident Insurance Ordinance as applied mutatis mutandis pursuant to Article 46-24 of the Industrial Accident Insurance Ordinance of a person who has been made able to receive insurance benefits under the provisions of the Industrial Accident Insurance Act pursuant to Article 35, paragraph (1) of the Industrial Accident Insurance Act (hereinafter referred to as an "insured person of Class II special enrollment"); provided, however, that the amount specified by Order of the Ministry of Health, Labour and Welfare as referred to in Article 14, paragraph (1) of the Act for a person who has newly become an insured person of Class II special enrollment in the middle of an insurance year or a person who has ceased to fall under the persons listed in Article 33, items (iii) through (v) of the Industrial Accident Insurance Act (including a person who is a member of an association whose insurance relation has become extinct pursuant to Article 35, paragraph (3) or (4) of the Industrial Accident Insurance Act) is the amount obtained by multiplying the amount obtained by dividing by 12 the amount listed in the right column of Appended Table 4 corresponding to the basic daily benefit amount under Article 46-20, paragraph (1) of the Industrial Accident Insurance Ordinance as applied mutatis mutandis pursuant to Article 46-24 of the Industrial Accident Insurance Ordinance (if the amount includes a fraction of less than one yen, the fraction is rounded up to one yen) by the number of months of the period during which the person was an insured person of Class II special enrollment during that insurance year (if the number of months includes a fraction of less than one month, it is deemed to be one month).
法第十四条第一項の厚生労働省令で定める額は、労災保険法第三十五条第一項の規定により労災保険法の規定による保険給付を受けることができることとされた者（以下「第二種特別加入者」という。）の労災則第四十六条の二十四において準用する労災則第四十六条の二十第一項の給付基礎日額に応ずる別表第四の右欄に掲げる額とする。ただし、保険年度の中途に新たに第二種特別加入者となつた者又は労災保険法第三十三条第三号から第五号までに掲げる者に該当しなくなつた者（労災保険法第三十五条第三項又は第四項の規定により保険関係が消滅した団体の構成員である者を含む。）の法第十四条第一項の厚生労働省令で定める額は、労災則第四十六条の二十四において準用する労災則第四十六条の二十第一項の給付基礎日額に応ずる別表第四の右欄に掲げる額を十二で除して得た額（その額に一円未満の端数があるときは、これを一円に切り上げる。）に当該者が当該保険年度中に第二種特別加入者とされた期間の月数（その月数に一月未満の端数があるときは、これを一月とする。）を乗じて得た額とする。
