If an action to suspend or prevent an infringement pursuant to the provisions of Article 24 has been filed, and an action pursuant to the Article in connection with the same or similar acts are pending before another court, when the court finds it proper in consideration of the addresses or locations of the parties, addresses of witnesses to be examined, the commonality of issues or evidence, and any other circumstances, the court may transfer the case in whole or in part to the relevant other court or other courts having jurisdiction over the relevant action pursuant to the provisions of Article 84-2, paragraph (1), upon petition or by the court's own authority.
裁判所は、第二十四条の規定による侵害の停止又は予防に関する訴えが提起された場合において、他の裁判所に同一又は同種の行為に係る同条の規定による訴訟が係属しているときは、当事者の住所又は所在地、尋問を受けるべき証人の住所、争点又は証拠の共通性その他の事情を考慮して、相当と認めるときは、申立てにより又は職権で、訴訟の全部又は一部について、当該他の裁判所又は当該訴えにつき第八十四条の二第一項の規定により管轄権を有する他の裁判所に移送することができる。
