Where an insured person with optional and continued coverage loses that status before the period covered by advance payment elapses, after paying premiums in advance pursuant to Article 165, paragraph (1) of the Act, the portion of the premiums paid in advance that relates to the unelapsed period is to be refunded upon the request of that person (where the person has come to fall under Article 38, item (ii) of the Act, the heir of that person).
法第百六十五条第一項の規定により保険料を前納した後、前納に係る期間の経過前において任意継続被保険者がその資格を喪失した場合においては、その者（法第三十八条第二号に該当するに至った場合においては、その者の相続人）の請求に基づき、前納した保険料のうち未経過期間に係るものを還付する。
The refund amount relating to the unelapsed period prescribed in the preceding paragraph is the amount equivalent to the amount that would be payable if the premiums for that unelapsed period were to be paid in advance at the time of losing status as an insured person with optional and continued coverage.
前項に規定する未経過期間に係る還付額は、任意継続被保険者の資格を喪失した時において当該未経過期間につき保険料を前納するものとした場合におけるその前納すべき額に相当する額とする。
