Article 17Businesses Subject to the Provisions of Article 12, Paragraph (3) of the Act

①The businesses employing 100 or more workers under Article 12, paragraph (3), item (i) of the Act and the businesses employing 20 or more but less than 100 workers under item (ii) of that paragraph are the businesses in which the number of workers obtained by dividing by 12 the total number of workers employed on the last day of each month during the insurance year in question (where there is a wage closing date, on the wage closing date immediately preceding the last day of each month) is 100 or more and 20 or more but less than 100, respectively; provided, however, that for a business of handling cargo at docks, on ships, at quays, at wharves, at railway stations or in warehouses, they are the businesses in which the number of workers obtained by dividing the cumulative number of workers employed during the insurance year in question by the number of scheduled working days during the insurance year is 100 or more and 20 or more but less than 100, respectively.

②The value specified by Order of the Ministry of Health, Labour and Welfare as referred to in Article 12, paragraph (3), item (ii) of the Act is 0.4.

③The scale specified by Order of the Ministry of Health, Labour and Welfare as referred to in Article 12, paragraph (3), item (iii) of the Act is that, for a construction business and a felling of standing trees business, the amount of final insurance premiums for the insurance year in question is 400,000 yen or more.
