Rules on Outside Work, etc. of Physicians and Dentists on Staff under Article 55-17, Paragraph (1) of the Immigration Control and Refugee Recognition Act
出入国管理及び難民認定法第五十五条の十七第一項の規定による医師等職員の兼業等に関する規則
In conjunction with the enforcement of the Act Partially Amending the Immigration Control and Refugee Recognition Act and the Special Act on the Immigration Control of, Inter Alia, Those Who Have Lost Japanese Nationality Pursuant to the Treaty of Peace with Japan (Act No. 56 of 2023), and based on the provisions of Article 55-17, paragraph (1) of the Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951), the Rules on Outside Work, etc. of Physicians and Dentists on Staff under Article 55-17, Paragraph (1) of the Immigration Control and Refugee Recognition Act are established as follows.
出入国管理及び難民認定法及び日本国との平和条約に基づき日本の国籍を離脱した者等の出入国管理に関する特例法の一部を改正する法律（令和五年法律第五十六号）の施行に伴い、及び出入国管理及び難民認定法（昭和二十六年政令第三百十九号）第五十五条の十七第一項の規定に基づき、出入国管理及び難民認定法第五十五条の十七第一項の規定による医師等職員の兼業等に関する規則を次のように定める。
第一条（法第五十五条の十七第一項に規定する内閣官房令・法務省令で定める施設）
The facilities specified by Order of the Cabinet Secretariat and the Ministry of Justice prescribed in Article 55-17, paragraph (1) of the Immigration Control and Refugee Recognition Act (hereinafter referred to as the "Act") are the following facilities:
出入国管理及び難民認定法（以下「法」という。）第五十五条の十七第一項に規定する内閣官房令・法務省令で定める施設は、次に掲げる施設とする。
a workplace at which an industrial physician is to be appointed as prescribed in Article 13, paragraph (1) of the Industrial Safety and Health Act (Act No. 57 of 1972);
労働安全衛生法（昭和四十七年法律第五十七号）第十三条第一項に規定する産業医を選任すべき事業場
a long-term care health facility prescribed in Article 8, paragraph (28) of the Long-Term Care Insurance Act (Act No. 123 of 1997);
介護保険法（平成九年法律第百二十三号）第八条第二十八項に規定する介護老人保健施設
a facility that conducts investigation, examination, autopsy or any other measure to clarify the cause of death or identity of dead bodies handled by the police and the Japan Coast Guard;
警察及び海上保安庁が取り扱う死体について、調査、検査、解剖その他死因又は身元を明らかにするための措置を行う施設
a facility that conducts external examination or autopsy of dead bodies as a medical examiner;
監察医として死体の検案又は解剖を行う施設
a facility where the person performs duties as a designated psychiatrist;
精神保健指定医として職務を行う施設
any other facility specified by the Commissioner of the Immigration Services Agency in consultation with the Prime Minister.
その他出入国在留管理庁長官が内閣総理大臣と協議して定める施設
Article 2Approval of Outside Medical Practice
第二条（部外診療の承認）
When the Commissioner of the Immigration Services Agency has received an application for approval of outside medical practice pursuant to Article 55-17, paragraph (1) of the Act, the Commissioner may approve the performance of that outside medical practice only if the Commissioner finds that all of the following requirements are met:
出入国在留管理庁長官は、法第五十五条の十七第一項の規定により部外診療の承認の申請を受けたときは、次に掲げる要件の全てに該当すると認める場合に限り、当該部外診療を行うことを承認することができる。
that it contributes to maintaining and improving the abilities necessary for the measures, etc. prescribed in Article 55-37 of the Act;
法第五十五条の三十七に定める措置等に必要な能力の維持向上に資するものであること。
that there is no risk of adversely affecting the efficient performance of duties on account of significant fatigue or any other physical or mental reason resulting from the outside work;
兼業による著しい疲労その他の身体上又は精神上の理由により、職務の能率的な遂行に悪影響を及ぼすおそれがないこと。
that engaging in the outside work does not risk damaging the confidence in the person as a national public employee or bringing discredit to the public office as a whole;
兼業することが、国家公務員としての信用を傷つけ、又は官職全体の不名誉となるおそれがないこと。
that, where the person would not work during regular working hours, there is no hindrance to the operation of public services.
正規の勤務時間において、勤務しないこととなる場合においては、公務の運営に支障がないこと。
An application for approval of outside medical practice must be made in writing stating the following matters:
部外診療の承認の申請は、次に掲げる事項を記載した書面によらなければならない。
the name, current address and public office held by the physician or dentist on staff (meaning a physician or dentist on staff prescribed in Article 55-17, paragraph (1) of the Act; the same applies hereinafter), and the grade of duties to which the person belongs;
医師等職員（法第五十五条の十七第一項に規定する医師等職員をいう。以下同じ。）の氏名、現住所及びその占める官職並びにその属する職務の級
the regular working hours of the physician or dentist on staff;
医師等職員の正規の勤務時間
the place of outside medical practice and the job title there;
部外診療先及びその職名
the working hours, content of work and scheduled period of outside medical practice at the place of outside medical practice;
部外診療先における勤務時間、勤務の内容及び部外診療の予定期間
whether there is a need for the physician or dentist on staff not to work during regular working hours, and the details thereof;
医師等職員がその正規の勤務時間において、勤務しないこととなる必要の有無及びその内容
the amount of remuneration, where the physician or dentist on staff performs outside medical practice for remuneration;
医師等職員が報酬を得て、部外診療を行う場合には、その金額
the reason outside medical practice is necessary;
部外診療を必要とする理由
other matters for reference.

Article 4Maintenance of Approval Ledger
第四条（承認台帳の整備）
The Commissioner of the Immigration Services Agency is to keep a ledger regarding approval of outside medical practice by physicians or dentists on staff and record the following matters in it:
出入国在留管理庁長官は、医師等職員の部外診療の承認に関する台帳を備え、これに次に掲げる事項を記載するものとする。
the date on which the outside medical practice was approved;
部外診療を承認した年月日
the name of the physician or dentist on staff, the public office held, and the grade of duties to which the person belongs;
医師等職員の氏名及びその占める官職並びにその属する職務の級
the place of outside medical practice and the job title there.
部外診療先及びその職名
the scheduled period of outside medical treatment
部外診療の予定期間
