Employment insurance examiner
雇用保険審査官
An official who decides requests for review (審査請求) under the Employment Insurance Act: of a confirmation that someone became or stopped being an insured person, of a decision on its benefits, or of an order to pay back benefits obtained by deception or other wrongdoing, or to pay a further sum on top of them (Act on Labor Insurance Examiners and the Labor Insurance Appeal Committee, Article 2, paragraph (2); Employment Insurance Act, Article 69, paragraph (1)). Examiners are placed in each prefectural labor bureau (都道府県労働局) and appointed by the Minister of Health, Labour and Welfare (Act on Labor Insurance Examiners and the Labor Insurance Appeal Committee, Articles 2-2 and 3), and a request goes to the examiner at the bureau for the area where the office that made the decision stands (Article 7, paragraph (1)). It must be made within three months from the day after the person learned of the decision, unless they show that a good reason kept them from making it in time (Article 8, paragraph (1)). A person dissatisfied with the examiner's decision can ask the Labor Insurance Appeal Committee (労働保険審査会) to review it again (Employment Insurance Act, Article 69, paragraph (1)). A person whose request has not been decided three months after the day after it was made may treat it as dismissed by the examiner (paragraph (2)). A court action to revoke the decision under review can be brought only after the examiner has decided (Article 71).
