The preceding paragraph also applies when a public prosecutor fails to follow the procedure provided in Article 461-2 or files a request for a summary order in violation of Article 462, paragraph (2).
検察官が、第四百六十一条の二に定める手続をせず、又は第四百六十二条第二項に違反して略式命令を請求したときも、前項と同様である。
The preceding paragraph also applies when a public prosecutor fails to follow the procedure provided in Article 461-2 or files a request for a summary order in violation of Article 462, paragraph (2).
