A kokoku-appeal under Article 433, paragraph (1) against a ruling dismissing the immediate appeal under the preceding paragraph, or against a ruling under Article 448, paragraph (1) rendered by the appellate court before which the immediate appeal under the preceding Article (limited to one against a ruling under Article 446 or Article 447, paragraph (1)) is pending, may be filed only when there are sufficient grounds to find that the ruling should be rescinded.
前項の即時抗告を棄却する決定又は前条の即時抗告（第四百四十六条又は第四百四十七条第一項の規定による決定に対するものに限る。）が係属する抗告裁判所の第四百四十八条第一項の規定による決定に対する第四百三十三条第一項の抗告は、当該決定が取り消されるべきものと認めるに足りる十分な根拠がある場合に限り、これをすることができる。
A kokoku-appeal under Article 433, paragraph (1) against a ruling dismissing the immediate appeal under the preceding paragraph, or against a ruling under Article 448, paragraph (1) as applied mutatis mutandis pursuant to Article 450-5, paragraph (1) rendered by the appellate court before which the immediate appeal under the preceding Article (limited to one against a ruling under Article 446 or Article 447, paragraph (1)) is pending, may be filed only when there are sufficient grounds to find that the ruling should be rescinded.
前項の即時抗告を棄却する決定又は前条の即時抗告（第四百四十六条又は第四百四十七条第一項の規定による決定に対するものに限る。）が係属する抗告裁判所の第四百五十条の五第一項において準用する第四百四十八条第一項の規定による決定に対する第四百三十三条第一項の抗告は、当該決定が取り消されるべきものと認めるに足りる十分な根拠がある場合に限り、これをすることができる。
