The provisions of Articles 271-3 through 271-8 apply mutatis mutandis where the extract of the written request for alteration of counts, etc. is submitted pursuant to paragraph (2). In this case, the phrase "paragraph (1), item (i), (c), (1) or item (ii), (a) of the preceding Article" in Article 271-3, paragraph (3) is deemed to be replaced with "Article 271-2, paragraph (1), item (i), (c), (1) or item (ii), (a)", the phrase "Article 271-2, paragraph (4)" in Article 271-5, paragraph (1) with "Article 312-2, paragraph (3)", and the phrase "paragraph (1), item (i) or item (ii) of that Article" in Article 271-6, paragraph (5) and Article 271-8, paragraph (1) with "Article 271-2, paragraph (1), item (i) or item (ii)".
第二百七十一条の三から第二百七十一条の八までの規定は、第二項の規定による訴因変更等請求書面抄本等の提出がある場合について準用する。この場合において、第二百七十一条の三第三項中「前条第一項第一号ハ（１）」とあるのは「第二百七十一条の二第一項第一号ハ（１）」と、第二百七十一条の五第一項中「第二百七十一条の二第四項」とあるのは「第三百十二条の二第三項」と、第二百七十一条の六第五項及び第二百七十一条の八第一項中「同条第一項第一号」とあるのは「第二百七十一条の二第一項第一号」と読み替えるものとする。

第二項第一項の規定による訴因変更等請求書面抄本等の提出求めがある場合について準用する。この場合において、第二百七十一条の三第三項中「前条第一項第一号ハ（１）」とあるのは「第二百七十一条の二第一項第一号ハ（１）」と、第一項及び第二百七十一条の四第二項中「公訴の提起」とあるのは「第三百十二条第一項の請求」と、第二百七十一条の三第一項及び第二項並びに第二百七十一条の四第二項及び第三項中「起訴状」とあるのは「訴因変更等請求書面」と、第二百七十一条の三第三項中「前条第一項第一号ハ（１）」とあるのは「第二百七十一条の二第一項第一号ハ（１）」と、同項、同条第四項並びに第二百七十一条の四第四項及び第五項中「起訴状抄本等」とあるのは「訴因変更等請求書面抄本等」と、第二百七十一条の五第一項中「第二百七十一条の二第四項」とあるのは「第三百十二条の二第三項」と、第二百七十一条の六第五項第二項から第六項まで及び第二百七十一条の八第一項中「同条第一項項第一号」とあるのは「第二百七十一条の二第一項第一号」と読み替えるものとする。
