when the name or address, or the particulars identifying an individual, pertaining to the measures do not fall under the particulars identifying an individual stated in the charging sheet that are not stated in the extract of the charging sheet, etc., or the particulars identifying an individual stated in the written request for alteration of counts, etc. that are not stated in the extract of the written request for alteration of counts, etc. (excluding those pertaining to a request under Article 312, paragraph (1) where a ruling dismissing that request has been made);
当該措置に係る氏名若しくは住居又は個人特定事項が起訴状に記載された個人特定事項のうち起訴状抄本等に記載がないもの又は訴因変更等請求書面に記載された個人特定事項のうち訴因変更等請求書面抄本等に記載がないもの（第三百十二条第一項の請求を却下する決定があつた場合における当該請求に係るものを除く。）に該当しないとき。
