第三条（担保権利者に対する権利を行使すべき旨の催告に関する経過措置）
A request made by the court before the Effective Date pursuant to the provisions of Article 79, paragraph (3) of the Code of Civil Procedure as it was before amendment by the provisions of Article 2 (hereinafter referred to as the "Code of Civil Procedure Before the Article 2 Amendment") (including as applied mutatis mutandis pursuant to Article 259, paragraph (6), Article 376, paragraph (2) or Article 405, paragraph (2) of the Code of Civil Procedure or other Acts) is, on or after the Effective Date, deemed to be a request made by a court clerk pursuant to the provisions of Article 79, paragraph (3) of the Code of Civil Procedure After the Article 2 Amendment (including as applied mutatis mutandis pursuant to Article 259, paragraph (6), Article 376, paragraph (2) or Article 405, paragraph (2) of the Code of Civil Procedure or other Acts).
施行日前に第二条の規定による改正前の民事訴訟法（以下「第二条改正前民事訴訟法」という。）第七十九条第三項（民事訴訟法第二百五十九条第六項、第三百七十六条第二項若しくは第四百五条第二項又は他の法律において準用する場合を含む。）の規定によりされた裁判所による催告は、施行日以後は、第二条改正後民事訴訟法第七十九条第三項（民事訴訟法第二百五十九条第六項、第三百七十六条第二項若しくは第四百五条第二項又は他の法律において準用する場合を含む。）の規定によりされた裁判所書記官による催告とみなす。
