Supplementary Provisions, Article 104Transitional Measures Accompanying the Partial Amendment of the Code of Civil Procedure
第百四条（民事訴訟法の一部改正に伴う経過措置）
Among service under the provisions of the second sentence of Article 105 of the Code of Civil Procedure prior to its amendment by the provisions of Article 105 (referred to as the "Former Act" in the following paragraph), service effected by a person engaged in postal services at a post office before this Act comes into effect is, for the purpose of applying the provisions of Article 104, paragraph (3), item (ii) of the Code of Civil Procedure as amended by the provisions of Article 105 (referred to as the "New Act" in that paragraph), deemed to be service effected at a business office of Japan Post Service Co., Ltd. (including a business office of a person entrusted by Japan Post Service Co., Ltd. with the work of that service; the same applies in the following paragraph).
この法律の施行前に第百五条の規定による改正前の民事訴訟法（次項において「旧法」という。）第百五条後段の規定による送達のうち郵便の業務に従事する者が郵便局においてしたものは、第百五条の規定による改正後の民事訴訟法（同項において「新法」という。）第百四条第三項第二号の規定の適用については、郵便事業株式会社の営業所（郵便事業株式会社から当該送達の業務の委託を受けた者の営業所を含む。次項において同じ。）においてした送達とみなす。
Service under the provisions of the second sentence of Article 106, paragraph (1) of the Former Act effected by a person engaged in postal services at a post office before this Act comes into effect is, for the purpose of applying the provisions of Article 104, paragraph (3), item (ii) of the New Act, deemed to be service under the provisions of the second sentence of Article 106, paragraph (1) of the New Act effected by a person engaged in postal services at a business office of Japan Post Service Co., Ltd.
この法律の施行前に郵便の業務に従事する者が郵便局においてした旧法第百六条第一項後段の規定による送達は、新法第百四条第三項第二号の規定の適用については、郵便の業務に従事する者が郵便事業株式会社の営業所においてした新法第百六条第一項後段の規定による送達とみなす。
