Article 6Adjudication of Disappearance

第六条(失踪の宣告)

The court may make an adjudication of their disappearance under Japanese law where an absentee had domicile in Japan or had Japanese nationality, at the latest point of time when they were found to be alive.

裁判所は、不在者が生存していたと認められる最後の時点において、不在者が日本に住所を有していたとき又は日本の国籍を有していたときは、日本法により、失踪の宣告をすることができる。

Even in the case where the preceding paragraph does not apply, if an absentee's property is situated in Japan, or if an absentee's legal relationship should be governed by Japanese law or is connected with Japan in light of the nature of the legal relationship, the domicile or nationality of the party and any other circumstances concerned, the court may, by applying Japanese law, make an adjudication of the absentee's disappearance only with regard to the property or the relevant legal relationship, respectively.

前項に規定する場合に該当しないときであっても、裁判所は、不在者の財産が日本に在るときはその財産についてのみ、不在者に関する法律関係が日本法によるべきときその他法律関係の性質、当事者の住所又は国籍その他の事情に照らして日本に関係があるときはその法律関係についてのみ、日本法により、失踪の宣告をすることができる。
