In cases where the law of a party's habitual residence governs, if their habitual residence is unknown, the law of their residence governs; provided, however, that this does not apply with regard to the application of Article 25 (including cases where it is applied mutatis mutandis pursuant to Article 26, paragraph (1) and Article 27).
