Article 29Formation of Parent-Child Relationship with Child Born Out of Wedlock

第二十九条(嫡出でない子の親子関係の成立)

In the case of a child born out of wedlock, the formation of a parent-child relationship with regard to the father and the child is governed by the father's national law at the time of the child's birth, and with regard to the mother and the child by the mother's national law at the time. In this case, when establishing a parent-child relationship by acknowledgment of parentage of a child, if obtaining the acceptance or consent from the child or a third party is required for acknowledgement under the child's national law at the time of the acknowledgement, the requirement must also be satisfied.

嫡出でない子の親子関係の成立は、父との間の親子関係については子の出生の当時における父の本国法により、母との間の親子関係についてはその当時における母の本国法による。この場合において、子の認知による親子関係の成立については、認知の当時における子の本国法によればその子又は第三者の承諾又は同意があることが認知の要件であるときは、その要件をも備えなければならない。

Acknowledgement of parentage of a child is governed by the law designated in the first sentence of the preceding paragraph, or by the national law of the acknowledging person or of the child at the time of the acknowledgement. In this case, if the acknowledging person's national law is to govern, the second sentence of the preceding paragraph applies mutatis mutandis.

子の認知は、前項前段の規定により適用すべき法によるほか、認知の当時における認知する者又は子の本国法による。この場合において、認知する者の本国法によるときは、同項後段の規定を準用する。

If a father has died before his child's birth, the father's national law at the time of his death is deemed to be the father's national law set forth in paragraph (1). If the person prescribed in the preceding paragraph has died before the acknowledgment, the person's national law at the time of this person's death is deemed to be the person's national law set forth in that paragraph.

父が子の出生前に死亡したときは、その死亡の当時における父の本国法を第一項の父の本国法とみなす。前項に規定する者が認知前に死亡したときは、その死亡の当時におけるその者の本国法を同項のその者の本国法とみなす。
