If the defendant makes a claim in a counterclaim that is subject to the jurisdiction of the district court, the summary court, at the petition of the adverse party, must transfer the principal action and counterclaim to the district court in the form of a ruling. In such a case, the provisions of Article 22 apply mutatis mutandis.
被告が反訴で地方裁判所の管轄に属する請求をした場合において、相手方の申立てがあるときは、簡易裁判所は、決定で、本訴及び反訴を地方裁判所に移送しなければならない。この場合においては、第二十二条の規定を準用する。
