Article 244

If one or both parties fails to appear or leaves court without presenting oral arguments on a date for oral arguments, and the court finds it to be appropriate in consideration of the current status of the trial and the status of each party's conduct of the litigation, it may reach a final judgment; provided, however, that if one of the parties fails to appear or leaves court without presenting an oral argument on a date for oral arguments, this applies only at the request of the adverse party who appeared on that date.
