Article 181Authority of examination committee for Long-Term Care Benefit expenses, etc.
第百八十一条（給付費等審査委員会の権限）
An examination committee for Long-Term Care Benefit expenses, etc., when it is determined necessary for the examination of invoices for Long-Term Care Benefit expenses, after obtaining the approval of the prefectural governor, may request said Designated In-Home Service Provider, Designated Provider of Preventive Long-Term Care Service, or Facility Covered by Long-Term Care Insurance to report, or to submit or present record books and documents, or may request an Establisher or manager, or the head, of said Designated In-Home Service Provider, Designated Provider of Preventive Long-Term Care Service, or Facility Covered by Long-Term Care Insurance, or a Person in Charge of Service Covered by Long-Term Care Benefits, etc. at a Business Office pertaining to the business of said Designated In-Home Service or the business of Designated Preventive Long-Term Care Service or at a Facility Covered by Long-Term Care Insurance, to appear or provide an explanation.
給付費等審査委員会は、介護給付費請求書の審査を行うため必要があると認めるときは、都道府県知事の承認を得て、当該指定居宅サービス事業者、指定介護予防サービス事業者若しくは介護保険施設に対して、報告若しくは帳簿書類の提出若しくは提示を求め、又は当該指定居宅サービス事業者、指定介護予防サービス事業者若しくは介護保険施設の開設者若しくは管理者若しくはその長若しくは当該指定居宅サービスの事業若しくは指定介護予防サービスの事業に係る事業所若しくは介護保険施設における介護給付等対象サービス担当者に対して、出頭若しくは説明を求めることができる。
An examination committee for Long-Term Care Benefit expenses, etc., when it is determined necessary for the examination of invoices for Long-Term Care Benefit expenses or invoices for Comprehensive Project for Long-Term Care Prevention and Daily Life Support expenses, after obtaining the approval of the mayor of the Municipality, may request said Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, Designated Preventive Long-Term Care Support Provider, Designated Provider, or trustee to report, or to submit or present record books and documents, or may request said Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, Designated Preventive Long-Term Care Support Provider, Designated Provider, or trustee, or a Person in Charge of Service Covered by Long-Term Care Benefits, etc. at a Business Office pertaining to the business of said Designated Community-Based Service, the Designated In-Home Long-Term Care Support Business, the business of Designated Community-Based Service for Preventive Long-Term Care, or the business of Designated Preventive Long-Term Care Support, or a Person in Charge of Comprehensive Project for Long-Term Care Prevention and Daily Life Support at a Designated Provider or trustee, to appear or provide an explanation.
給付費等審査委員会は、介護給付費請求書又は介護予防・日常生活支援総合事業費請求書の審査を行うため必要があると認めるときは、市町村長の承認を得て、当該指定地域密着型サービス事業者、指定居宅介護支援事業者、指定地域密着型介護予防サービス事業者若しくは指定介護予防支援事業者若しくは指定事業者若しくは受託者に対して、報告若しくは帳簿書類の提出若しくは提示を求め、又は当該指定地域密着型サービス事業者、指定居宅介護支援事業者、指定地域密着型介護予防サービス事業者若しくは指定介護予防支援事業者若しくは指定事業者若しくは受託者若しくは当該指定地域密着型サービスの事業、指定居宅介護支援の事業、指定地域密着型介護予防サービスの事業若しくは指定介護予防支援の事業に係る事業所における介護給付等対象サービス担当者若しくは指定事業者若しくは受託者における介護予防・日常生活支援総合事業担当者に対して、出頭若しくは説明を求めることができる。
An Association must pay the travel expenses, a daily allowance, and accommodation charges of a person that appears before an examination committee for Long-Term Care Benefit expenses, etc. pursuant to the provisions of the preceding two paragraphs, however, provided that this provision does not apply to those who appear pursuant to a request for appearance due to a defective or improper entry of an invoice for Long-Term Care Benefit expenses, an invoice for Comprehensive Project for Long-Term Care Prevention and Daily Life Support expenses, or the record books and documents that are submitted by said Designated In-Home Service Provider, Designated Provider of Preventive Long-Term Care Service, Facility Covered by Long-Term Care Insurance, Designated Community-Based Service Provider, Designated In-Home Long-Term Care Support Provider, Designated Provider of Community-Based Service for Preventive Long-Term Care, or Designated Preventive Long-Term Care Support Provider, or Designated Provider or trustee.
連合会は、前二項の規定により給付費等審査委員会に出頭した者に対し、旅費、日当及び宿泊料を支給しなければならない。ただし、当該指定居宅サービス事業者、指定介護予防サービス事業者、介護保険施設、指定地域密着型サービス事業者、指定居宅介護支援事業者、指定地域密着型介護予防サービス事業者若しくは指定介護予防支援事業者又は指定事業者若しくは受託者が提出した介護給付費請求書若しくは介護予防・日常生活支援総合事業費請求書又は帳簿書類の記載が不備又は不当であったため出頭を求められて出頭した者に対しては、この限りでない。
