The provisions of Article 86, paragraph (2), Articles 87 through 89, Article 91, paragraph (1), and Article 93 apply mutatis mutandis to a special appeal and proceedings in the instance of the appeal. In this case, the phrase "and paragraph (5)" in Article 87, paragraph (6) is deemed to be replaced with "through paragraph (6)".
第八十六条第二項、第八十七条から第八十九条まで、第九十一条第一項及び第九十三条の規定は、特別抗告及びその抗告審に関する手続について準用する。この場合において、第八十七条第六項中「及び第五項」とあるのは、「から第六項まで」と読み替えるものとする。
