the case is based on a petition filed by a person who has been a husband or wife and is domiciled in Japan, and the person who has been a husband and the person who has been a wife were last domiciled together in Japan; or
日本国内に住所がある夫又は妻であった者の一方からの申立てであって、夫であった者及び妻であった者が最後の共通の住所を日本国内に有していたとき。
