Supplementary Provisions, Article 3, paragraph (1)
中小事業主（その資本金の額又は出資の総額が三億円（小売業又はサービス業を主たる事業とする事業主については五千万円、卸売業を主たる事業とする事業主については一億円）以下である事業主及びその常時使用する労働者の数が三百人（小売業を主たる事業とする事業主については五十人、卸売業又はサービス業を主たる事業とする事業主については百人）以下である事業主をいう。第四項及び附則第十一条において同じ。）の事業に係る協定（新労基法第百三十九条第二項に規定する事業、第百四十条第二項に規定する業務、第百四十一条第四項に規定する者及び第百四十二条に規定する事業に係るものを除く。）についての前条の規定の適用については、「平成三十一年四月一日」とあるのは、「令和二年四月一日」とする。
With regard to the application of the provisions of the preceding Article to an agreement pertaining to the business of a small and medium-sized business operator (meaning a business operator whose amount of stated capital or total amount of contributions is 300 million yen or less (50 million yen or less for a business operator whose principal business is retail or services, and 100 million yen or less for a business operator whose principal business is wholesale) and a business operator whose number of regularly employed workers is 300 or less (50 or less for a business operator whose principal business is retail, and 100 or less for a business operator whose principal business is wholesale or services); the same applies in paragraph (4) and in Article 11 of the Supplementary Provisions) (excluding an agreement pertaining to a business prescribed in Article 139, paragraph (2), work prescribed in Article 140, paragraph (2), persons prescribed in Article 141, paragraph (4) and a business prescribed in Article 142 of the new Labor Standards Act), the term "April 1, 2019" is deemed to be replaced with "April 1, 2020".
