第二十八条
A registration certificate possessed by a special permanent resident is deemed to be a special permanent resident certificate for the purpose of the application of the provisions of Article 10 of the Special Act (excluding paragraphs (1) and (4)), Article 12, paragraphs (1) and (2), Article 13, paragraph (1), Article 14, paragraphs (1) through (3) (excluding the second sentence of paragraph (1)), Articles 15 through 17, Article 19, paragraph (1) (limited to the part pertaining to Article 10, paragraphs (2) and (3) of the Special Act; the same applies hereinafter in this paragraph), Article 19, paragraphs (2) and (3) (both limited to the part pertaining to paragraph (1) of that Article, including where these provisions apply mutatis mutandis under Article 32, paragraph (2) of the Supplementary Provisions) and Article 23, paragraph (2) of the Special Act, and Article 30 of the Supplementary Provisions (limited to the part pertaining to paragraph (1), items (i) and (ii)) and Article 32, paragraph (1) of the Supplementary Provisions (limited to the part pertaining to Article 30, paragraph (1) of the Supplementary Provisions and Article 10, paragraph (3) of the Special Act as applied mutatis mutandis pursuant to Article 30, paragraph (2) of the Supplementary Provisions) (including the penal provisions pertaining to these provisions).
特別永住者が所持する登録証明書は、特例法第十条（第一項及び第四項を除く。）、第十二条第一項及び第二項、第十三条第一項、第十四条第一項から第三項まで（第一項後段を除く。）、第十五条から第十七条まで、第十九条第一項（特例法第十条第二項及び第三項に係る部分に限る。以下この項において同じ。）、第十九条第二項及び第三項（いずれも同条第一項に係る部分に限り、これらの規定を附則第三十二条第二項において準用する場合を含む。）並びに第二十三条第二項並びに附則第三十条（第一項第一号及び第二号に係る部分に限る。）及び第三十二条第一項（附則第三十条第一項及び同条第二項において準用する特例法第十条第三項に係る部分に限る。）の規定（これらの規定に係る罰則を含む。）の適用については、特別永住者証明書とみなす。
In the case where a registration certificate is deemed to be a special permanent resident certificate pursuant to the provisions of the preceding paragraph, its period of validity is the period until the day specified in each of the following items for the category of special permanent resident set forth in that item has elapsed.
前項の規定により登録証明書が特別永住者証明書とみなされる場合におけるその有効期間は、次の各号に掲げる特別永住者の区分に応じ、当該各号に定める日が経過するまでの期間とする。
a person who has not reached 16 years of age on the Effective Date: the person's 16th birthday;
施行日に十六歳に満たない者 十六歳の誕生日
a person who is 16 years of age or older on the Effective Date and for whom the seventh birthday after the date on which the person was registered under the provisions of Article 4, paragraph (1) of the Former Alien Registration Act (or, where the person has received confirmation under the provisions of Article 6, paragraph (3), Article 6-2, paragraph (4) or Article 7, paragraph (3) of the Former Alien Registration Act, or confirmation based on an application under the provisions of Article 11, paragraph (1) or (2) of the Former Alien Registration Act, the date on which the person last received confirmation; referred to as the "date of registration, etc." in the following item) falls on or before the date on which three years have elapsed from the Effective Date: the date on which three years have elapsed from the Effective Date;
施行日に十六歳以上の者であって、旧外国人登録法第四条第一項の規定による登録を受けた日（旧外国人登録法第六条第三項、第六条の二第四項若しくは第七条第三項の規定による確認又は旧外国人登録法第十一条第一項若しくは第二項の規定による申請に基づく確認を受けた場合には、最後に確認を受けた日。次号において「登録等を受けた日」という。）後の七回目の誕生日が施行日から起算して三年を経過する日までに到来するもの 施行日から起算して三年を経過する日
a person who is 16 years of age or older on the Effective Date and for whom the seventh birthday after the date of registration, etc. falls after the date on which three years have elapsed from the Effective Date: that birthday.
施行日に十六歳以上の者であって、登録等を受けた日後の七回目の誕生日が施行日から起算して三年を経過する日後に到来するもの 当該誕生日
A special permanent resident who possesses a registration certificate that is deemed to be a special permanent resident certificate pursuant to the provisions of paragraph (1) may, before the period of validity prescribed in the preceding paragraph expires, apply to the Commissioner of the Immigration Services Agency for the issuance of a special permanent resident certificate, via the mayor of the municipality in which the place of residence is situated, in accordance with the procedures prescribed by the Ministry of Justice Order.
The Commissioner of the Immigration Services Agency is to, if an application is filed under the preceding paragraph, issue a special permanent resident certificate to the relevant special permanent resident via the mayor of the municipality in which the place of residence is situated.
出入国在留管理庁長官は、前項の規定による申請があった場合には、居住地の市町村の長を経由して、当該特別永住者に対し、特別永住者証明書を交付するものとする。
