第十二条（老人訪問看護療養費の支給等に関する規定の施行前の準備）
When the Minister of Health and Welfare intends to specify the Ministry of Health and Welfare Order referred to in Article 46-17-5, paragraph (1) of the New Elderly Health Act, and when the Minister intends to specify the standards for the operation of the business of designated home-nursing for the elderly prescribed in paragraph (2) of that Article (excluding the part concerning the handling of designated home-nursing for the elderly), the Minister may hear the opinion of the Elderly Health Council even before the date of enforcement of the provisions set forth in Article 1, item (ii) of the Supplementary Provisions.
厚生大臣は、新老健法第四十六条の十七の五第一項の厚生省令を定めようとするとき、及び同条第二項に規定する指定老人訪問看護の事業の運営に関する基準（指定老人訪問看護の取扱いに関する部分を除く。）を定めようとするときは、附則第一条第二号に掲げる規定の施行の日前においても老人保健審議会の意見を聴くことができる。
When the Minister of Health and Welfare intends to specify the standards referred to in Article 46-5-2, paragraph (2) of the New Elderly Health Act and the standards for the operation of the business of designated home-nursing for the elderly prescribed in Article 46-17-5, paragraph (2) of the New Elderly Health Act (limited to the part concerning the handling of designated home-nursing for the elderly), the Minister may hear the opinion of the Central Social Insurance Medical Council even before the date of enforcement of the provisions set forth in Article 1, item (ii) of the Supplementary Provisions.
厚生大臣は、新老健法第四十六条の五の二第二項の基準及び新老健法第四十六条の十七の五第二項に規定する指定老人訪問看護の事業の運営に関する基準（指定老人訪問看護の取扱いに関する部分に限る。）を定めようとするときは、附則第一条第二号に掲げる規定の施行の日前においても中央社会保険医療協議会の意見を聴くことができる。
