Supplementary Provisions, Article 10

一an amount equivalent to 7/10 of the sum total of the following amounts:

イthe amount obtained by multiplying the amount obtained by deducting the pre-commencement medical expenses outside adjustment (meaning, where the relevant Insurer is an insurer exceeding the fixed pre-commencement standard (meaning an Insurer for which the rate obtained by dividing the amount calculated as specified by Ministry of Health and Welfare Order as the pre-commencement elderly medical expenses per participant aged 70 or over, etc. pertaining to one Insurer by the amount calculated as specified by Ministry of Health and Welfare Order as the average amount of the pre-commencement elderly medical expenses per participant aged 70 or over, etc. pertaining to all Insurers (hereinafter in this item referred to as the "per-person average of elderly medical expenses") exceeds the rate specified by Cabinet Order in Article 55, paragraph (1), item (i) of the Former Elderly Health Act), the amount calculated as specified by Ministry of Health and Welfare Order as the portion of the pre-commencement elderly medical expenses pertaining to the relevant Insurer that exceeds the amount obtained by multiplying the per-person average of elderly medical expenses by the rate specified by Cabinet Order; the same applies in (b)) from the pre-commencement elderly medical expenses pertaining to the relevant Insurer (meaning the amount of expenses, defrayed by Municipalities in fiscal year 1991, required for medical care (including payment of medical expenses), payment of specified medical expenses (including payment of medical expenses), and payment of medical expenses for health care facilities for the elderly provided before the Effective Date to participants aged 70 or over, etc. pertaining to one Insurer; the same applies hereinafter in this item) by the fixed participant adjustment rate under Article 56, paragraph (2) of the Former Elderly Health Act for fiscal year 1991;

二an amount equivalent to 7/10 of the amount obtained by multiplying the sum total of the following amounts (referred to as "post-commencement adjusted elderly medical expenses" in the following item) by the rate obtained by deducting the post-commencement fixed rate of medical expenses for health care facilities for the elderly, etc. from 1;

イthe amount obtained by multiplying the amount obtained by deducting the post-commencement medical expenses outside adjustment (meaning, in the case where the Insurer concerned is an insurer exceeding the fixed post-commencement standard (meaning an Insurer for which the rate obtained by dividing the amount calculated as specified by Ministry of Health and Welfare Order as the post-commencement elderly medical expenses per participant, etc. aged 70 or older pertaining to one Insurer by the amount calculated as specified by Ministry of Health and Welfare Order as the average of the post-commencement elderly medical expenses per participant, etc. aged 70 or older pertaining to all Insurers (hereinafter in this item referred to as the "per-person average of elderly medical expenses") exceeds the rate specified by the Cabinet Order referred to in Article 55, paragraph (1), item (i), (a) of the New Elderly Health Act), the amount calculated as specified by Ministry of Health and Welfare Order as the portion of the post-commencement elderly medical expenses pertaining to that Insurer that exceeds the amount obtained by multiplying the per-person average of elderly medical expenses by that rate specified by Cabinet Order; the same applies in (b)) from the post-commencement elderly medical expenses pertaining to the Insurer concerned (meaning the amount of expenses required for medical care, etc. provided on or after the Effective Date to participants, etc. aged 70 or older pertaining to one Insurer, which a municipality bore in fiscal year 1991; the same applies hereinafter in this Article) by the fixed participant adjustment rate under Article 56, paragraph (3) of the New Elderly Health Act for fiscal year 1991;

三an amount equivalent to 6/12 of the amount obtained by multiplying the post-commencement adjusted elderly medical expenses by the post-commencement fixed rate of medical expenses for health care facilities for the elderly, etc.
