Notwithstanding the provisions of Articles 7 and 8 of the new Act, the provisions of the Copyright Act that concern neighboring rights (including the provisions of ArticlesArticle 94-2 and; Articles 95 through 95-3; Article 95-395-5, paragraphs (3) and (4); ArticleArticles 97 through 97-3; and Article 97-397-5, paragraphs (3) through (5)) apply to a performance that takes place before this Act comes into effect (excluding a performance falling under one of the items of Article 7 of the new Act) and to a phonogram in which sounds are first fixed before this Act comes into effect (excluding a phonogram falling under one of the items of Article 8 of the new Act) for which a copyright under the former Act exists at the time this Act comes into effect.
この法律の施行前に行われた実演（新法第七条各号のいずれかに該当するものを除く。）又はこの法律の施行前にその音が最初に固定されたレコード（新法第八条各号のいずれかに該当するものを除く。）でこの法律の施行の際現に旧法による著作権が存するものについては、新法第七条及び第八条の規定にかかわらず、著作権法中著作隣接権に関する規定（第九十四条の二、第九十五条、から第九十五条の三第まで、第九十五条の五第三項及び第四項、第九十七条から第九十七条の三まで並びに第九十七条の三五第三項から第五項までの規定を含む。）を適用する。
