Supplementary Provisions, Article 15Special Provisions on the Establishment of the Organization for Employment for Skill Development for Foreign Nationals and the Dissolution of the Organization for Technical Intern Training
第十五条（外国人育成就労機構の設立及び外国人技能実習機構の解散に関する特則）
The Organization for Technical Intern Training established pursuant to the provisions of Chapter III, Section 2 of the Former Technical Intern Training Act is to, by the effective date, in the same manner as under the provisions of Articles 65 and 66 of This Act as Amended by Act No. 60 of 2024, prepare the articles of incorporation of the Organization for Employment for Skill Development for Foreign Nationals, file an application for authorization for the incorporation of the Organization for Employment for Skill Development for Foreign Nationals, and perform other acts necessary for the incorporation of the Organization for Employment for Skill Development for Foreign Nationals. In this case, the articles of incorporation prepared in the same manner as under the provisions of Article 65 of This Act as Amended by Act No. 60 of 2024 and the authorization for incorporation by the competent ministers received in the same manner as under the provisions of Article 66, paragraph (1) of This Act as Amended by Act No. 60 of 2024 are, on and after the effective date, deemed to be the articles of incorporation prepared pursuant to the provisions of Article 65 of This Act as Amended by Act No. 60 of 2024 and the authorization received pursuant to the provisions of that paragraph.
技能実習法第三章第二節の規定により設立された外国人技能実習機構は、施行日までに、育成就労法第六十五条及び第六十六条の規定の例により、外国人育成就労機構の定款の作成、外国人育成就労機構の設立の認可の申請その他外国人育成就労機構の設立に必要な行為を行うものとする。この場合において、育成就労法第六十五条の規定の例により作成された定款及び育成就労法第六十六条第一項の規定の例により受けた主務大臣による設立の認可は、施行日以後は、育成就労法第六十五条の規定により作成された定款及び同項の規定により受けた認可とみなす。
In the case where the Organization for Technical Intern Training performs acts necessary for the incorporation of the Organization for Employment for Skill Development for Foreign Nationals pursuant to the preceding paragraph, in Article 65, paragraph (1) of This Act as Amended by Act No. 60 of 2024, the phrase "Incorporators must promptly prepare articles of incorporation for the ESDO, and must solicit capital contributions for the ESDO from non-governmental persons" is deemed to be replaced with "The Organization for Technical Intern Training must, by the date of enforcement of the Act Partially Amending the Immigration Control and Refugee Recognition Act and the Act on Proper Technical Intern Training and Protection of Technical Intern Trainees (Act No. 60 of 2024; referred to as the 'Amending Act' in paragraph (1) of the following Article), prepare articles of incorporation for the ESDO"; in Article 66, paragraph (1) of This Act as Amended by Act No. 60 of 2024, the phrase "Upon the completion of the solicitation under paragraph (1) of the preceding Article, incorporators must promptly submit the articles of incorporation" is deemed to be replaced with "The Organization for Technical Intern Training must, by the date of enforcement of the Amending Act, submit the articles of incorporation of the ESDO"; in paragraph (2) of that Article, the phrase "The competent ministers nominate a person to be the president and persons to be inspectors of the ESDO" is deemed to be replaced with "The person to be the president and the persons to be inspectors of the ESDO are the persons who, at the time of the establishment of the ESDO, are actually the president and inspectors of the Organization for Technical Intern Training"; and in paragraph (3) of that Article, the phrase "The person nominated to be the president and the inspectors of the ESDO pursuant to the provisions of the preceding paragraph" is deemed to be replaced with "The person to be the president and the inspectors of the ESDO".
前項の規定により外国人技能実習機構が外国人育成就労機構の設立に必要な行為を行う場合においては、育成就労法第六十五条第一項中「発起人は、速やかに、機構の定款を作成し、政府以外の者に対し機構に対する出資を募集し」とあるのは「外国人技能実習機構は、出入国管理及び難民認定法及び外国人の技能実習の適正な実施及び技能実習生の保護に関する法律の一部を改正する法律（令和六年法律第六十号。次条第一項において「改正法」という。）の施行の日までに、機構の定款を作成し」と、育成就労法第六十六条第一項中「発起人は、前条第一項の募集が終わったときは、速やかに、定款」とあるのは「外国人技能実習機構は、改正法の施行の日までに、機構の定款」と、同条第二項中「主務大臣は、機構」とあるのは「機構」と、「を指名する」とあるのは「は、機構の成立の際現に外国人技能実習機構の理事長及び監事である者とする」と、同条第三項中「前項の規定により指名された機構」とあるのは「機構」と読み替えるものとする。
When the authorization under Article 66, paragraph (1) of This Act as Amended by Act No. 60 of 2024, as read with replaced terms pursuant to the preceding paragraph and as to be followed in the same manner pursuant to paragraph (1), has been received, the Organization for Employment for Skill Development for Foreign Nationals is established at the time this Act comes into effect, notwithstanding the provisions of Article 68, paragraph (2) of This Act as Amended by Act No. 60 of 2024.
第一項の規定によりその例によることとされる前項の規定により読み替えられた育成就労法第六十六条第一項の認可を受けたときは、外国人育成就労機構は、育成就労法第六十八条第二項の規定にかかわらず、この法律の施行の時に成立する。
The Organization for Technical Intern Training is to be dissolved at the time this Act comes into effect, and all of its rights and obligations are to be succeeded to by the Organization for Employment for Skill Development for Foreign Nationals at that time.
Notwithstanding the provisions of Article 68, paragraph (1) of This Act as Amended by Act No. 60 of 2024, the Organization for Employment for Skill Development for Foreign Nationals must complete the registration of its incorporation without delay after its establishment.
外国人育成就労機構は、育成就労法第六十八条第一項の規定にかかわらず、外国人育成就労機構の成立後遅滞なく、その設立の登記をしなければならない。
With regard to the application of Article 94, paragraph (3) and Article 114 (limited to the part pertaining to item (iii)) of the Former Technical Intern Training Act, the operations conducted by the Organization for Technical Intern Training pursuant to paragraph (1) are deemed to be the operations prescribed in Article 87 of that Act.
The registration of dissolution in the case where the Organization for Technical Intern Training is dissolved pursuant to paragraph (4) is specified by Cabinet Order.
In the case where the Organization for Technical Intern Training is dissolved pursuant to paragraph (4), the provisions of Article 102, paragraph (1) of This Act as Amended by Act No. 60 of 2024 do not apply.
第四項の規定により外国人技能実習機構が解散した場合については、育成就労法第百二条第一項の規定は、適用しない。
