第三十八条
The provisions of Article 13-5-6 of the Supplementary Provisions of the New Elderly Medical Care Assurance Act apply to the portion, corresponding to the period on or after the item (iii) Effective Date, of the delinquent charge prescribed in Article 45, paragraph (1) of the Act on Assurance of Medical Care for Elderly People (including as applied mutatis mutandis pursuant to Article 124 and Article 10 of the Supplementary Provisions of that Act), and the provisions then in force continue to govern the portion of that delinquent charge corresponding to the period before the item (iii) Effective Date.
新高齢者医療確保法附則第十三条の五の六の規定は、高齢者の医療の確保に関する法律第四十五条第一項（同法第百二十四条及び附則第十条において準用する場合を含む。）に規定する延滞金のうち第三号施行日以後の期間に対応するものについて適用し、当該延滞金のうち第三号施行日前の期間に対応するものについては、なお従前の例による。
