Supplementary Provisions, Article 9Special Provisions for Insured Persons Admitted to a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly
第九条（指定介護老人福祉施設に入所中の被保険者の特例）
An Insured Person who is found to have changed domicile to the location of a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly by being admitted to that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly, and who is found to have had a domicile in another Municipality (a Municipality other than the Municipality where that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly is located) when admitted to that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly, is, even in the case where that Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly has become a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care (limited to one that has received the designation under the main clause of Article 42-2, paragraph (1) with regard to a Business Office conducting the business of Daily Life Long-Term Care for a Person Admitted to a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care; hereinafter in this Article referred to as a "converted Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care") due to a decrease in the capacity of residents, while continuously admitted to that converted Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care, to be an Insured Person of Long-Term Care Insurance conducted by that other Municipality, notwithstanding the provisions of Article 9; provided, however, that this does not apply to an Insured Person who had continuously moved in for Admission, etc. at two or more Facilities Subject to Domicile Exception including a Designated Facility Covered by Public Aid Providing Long-Term Care to the Elderly that has become a converted Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care (hereinafter in this Article referred to as a "former Facility Covered by Public Aid Providing Long-Term Care to the Elderly") (limited to a person who is continuously admitted to that converted Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care), and who is found to have changed domicile consecutively to the location of each of the Facility Subject to Domicile Exception at which Admission, etc. was made immediately before admission to that former Facility Covered by Public Aid Providing Long-Term Care to the Elderly (hereinafter in this paragraph referred to as the "facility of immediately preceding admission") and the former Facility Covered by Public Aid Providing Long-Term Care to the Elderly, by moving in for Admission, etc. at each of the facility of immediately preceding admission and the former Facility Covered by Public Aid Providing Long-Term Care to the Elderly (referred to as an "insured person in specified continuous admission" in the following paragraph).
指定介護老人福祉施設に入所することにより当該指定介護老人福祉施設の所在する場所に住所を変更したと認められる被保険者であって、当該指定介護老人福祉施設に入所した際他の市町村（当該指定介護老人福祉施設が所在する市町村以外の市町村をいう。）の区域内に住所を有していたと認められるものは、当該指定介護老人福祉施設が入所定員の減少により地域密着型介護老人福祉施設（地域密着型介護老人福祉施設入所者生活介護の事業を行う事業所に係る第四十二条の二第一項本文の指定を受けているものに限る。以下この条において「変更後地域密着型介護老人福祉施設」という。）となった場合においても、当該変更後地域密着型介護老人福祉施設に継続して入所している間は、第九条の規定にかかわらず、当該他の市町村が行う介護保険の被保険者とする。ただし、変更後地域密着型介護老人福祉施設となった指定介護老人福祉施設（以下この条において「変更前介護老人福祉施設」という。）を含む二以上の住所地特例対象施設に継続して入所等をしていた被保険者（当該変更後地域密着型介護老人福祉施設に継続して入所している者に限る。）であって、当該変更前介護老人福祉施設に入所する直前に入所等をしていた住所地特例対象施設（以下この項において「直前入所施設」という。）及び変更前介護老人福祉施設のそれぞれに入所等をすることにより直前入所施設及び変更前介護老人福祉施設のそれぞれの所在する場所に順次住所を変更したと認められるもの（次項において「特定継続入所被保険者」という。）については、この限りでない。
Among insured persons in specified continuous admission, those set forth in the following items are Insured Persons of Long-Term Care Insurance conducted by the Municipality specified in each of those items, notwithstanding the provisions of Article 9:
特定継続入所被保険者のうち、次の各号に掲げるものは、第九条の規定にかかわらず、当該各号に定める市町村が行う介護保険の被保険者とする。
an Insured Person who is found to have changed domicile consecutively to the location of each of two or more Facilities Subject to Domicile Exception by moving in for Admission, etc. at each of those Facilities Subject to Domicile Exception at which the person had continuously moved in for Admission, etc., and who is found to have had a domicile in another Municipality (a Municipality other than the Municipality where the former Facility Covered by Public Aid Providing Long-Term Care to the Elderly is located) when moving in for Admission, etc. at the first Facility Subject to Domicile Exception among those two or more Facilities Subject to Domicile Exception: that other Municipality;
継続して入所等をしていた二以上の住所地特例対象施設のそれぞれに入所等をすることによりそれぞれの住所地特例対象施設の所在する場所に順次住所を変更したと認められる被保険者であって、当該二以上の住所地特例対象施設のうち最初の住所地特例対象施設に入所等をした際他の市町村（変更前介護老人福祉施設が所在する市町村以外の市町村をいう。）の区域内に住所を有していたと認められるもの 当該他の市町村
an Insured Person who is found to have changed domicile from a location other than the location where one Facility Subject to Domicile Exception is located to the location where another Facility Subject to Domicile Exception is located (hereinafter in this item referred to as a "Change of Specified Domicile") by continuously moving in for Admission, etc. at another Facility Subject to Domicile Exception from one Facility Subject to Domicile Exception among two or more Facilities Subject to Domicile Exception at which the person had continuously moved in for Admission, etc. (hereinafter in this item referred to as "continuous admission, etc."), and who is found to have had a domicile in another Municipality (a Municipality other than the Municipality where the former Facility Covered by Public Aid Providing Long-Term Care to the Elderly is located) when moving in for continuous admission, etc. pertaining to the most recent Change of Specified Domicile: that other Municipality.
継続して入所等をしていた二以上の住所地特例対象施設のうち一の住所地特例対象施設から継続して他の住所地特例対象施設に入所等をすること（以下この号において「継続入所等」という。）により当該一の住所地特例対象施設の所在する場所以外の場所から当該他の住所地特例対象施設の所在する場所への住所の変更（以下この号において「特定住所変更」という。）を行ったと認められる被保険者であって、最後に行った特定住所変更に係る継続入所等の際他の市町村（変更前介護老人福祉施設が所在する市町村以外の市町村をいう。）の区域内に住所を有していたと認められるもの 当該他の市町村
With regard to an Insured Person subject to the application of the provisions of the preceding two paragraphs, Article 13 is applied by deeming a converted Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care to be a Facility Subject to Domicile Exception.
前二項の規定の適用を受ける被保険者については、変更後地域密着型介護老人福祉施設を住所地特例対象施設とみなして、第十三条の規定を適用する。
