Cabinet Order on the Arrangement of Related Cabinet Orders and on Transitional Measures upon the Enforcement of the Act Partially Amending the Immigration Control and Refugee Recognition Act and the Act on Proper Technical Intern Training and Protection of Technical Intern Trainees

The Cabinet, in association with the enforcement of the Act Partially Amending the Immigration Control and Refugee Recognition Act and the Act on Proper Technical Intern Training and Protection of Technical Intern Trainees (Act No. 60 of 2024), and pursuant to the provisions of Article 15, paragraph (7) and Article 23 of the Supplementary Provisions of that Act, Article 69-2, paragraph (1) of the Immigration Control and Refugee Recognition Act (Cabinet Order No. 319 of 1951), Article 31, paragraph (1) and Article 104, paragraphs (1), (3) and (4) of the Act on Proper Implementation of Employment for Skill Development and Protection of Skill Development Employees (Act No. 89 of 2016), and the provisions of related Acts, establishes this Cabinet Order.

A supervising organization (meaning a supervising organization prescribed in Article 2, paragraph (10) of the Technical Intern Training Act; the same applies hereinafter) may, notwithstanding the provisions of Article 30, paragraph (1) and Article 33, paragraph (1) of the Employment Security Act (Act No. 141 of 1947), as a business, receive applications to post job openings and job-seeking applications, with only persons who intend to file an application for accreditation under Article 5, paragraph (1) of the Supplementary Provisions of the amending Act (excluding a person who intends to have supervised employment for skill development by worker dispatching, etc. (meaning supervised employment for skill development by worker dispatching, etc. prescribed in Article 8, paragraph (2) of the Act on Proper Implementation of Employment for Skill Development and Protection of Skill Development Employees as amended by the provisions of Article 2 of the amending Act (hereinafter referred to as the "Employment for Skill Development Act")) conducted in Japan as a client (meaning a client prescribed in Article 2, item (iv) of the Act on Ensuring the Proper Operation of Worker Dispatching Services and Protecting Dispatched Workers (Act No. 88 of 1985) or a client prescribed in Article 6, paragraph (17) of the Mariners' Employment Security Act (Act No. 130 of 1948))) as job posters, and with only foreign nationals who are to become subject to supervised employment for skill development (meaning supervised employment for skill development prescribed in Article 2, item (iii) of the Employment for Skill Development Act) as job seekers, and act as an intermediary for the establishment of employment relationships between job posters and job seekers pertaining to what corresponds to employment for skill development (meaning employment for skill development prescribed in Article 2, item (i) of the Employment for Skill Development Act).

The provisions of Article 27, paragraphs (2) through (4) of the Technical Intern Training Act apply mutatis mutandis to the business conducted by a supervising organization pursuant to the provisions of the preceding paragraph.

If, by the date on which a supervising organization commences the business under the provisions of paragraph (1), the supervising organization has notified the range of job categories, etc. (meaning the range of job categories, etc. prescribed in Article 29, paragraph (3) of the Employment Security Act; the same applies hereinafter) pursuant to the provisions of Article 32-12, paragraph (1) of the Employment Security Act (including as applied mutatis mutandis pursuant to Article 33, paragraph (4) of the Employment Security Act; the same applies hereinafter) as applied with deemed replacement of terms pursuant to the provisions of Article 27, paragraph (2) of the Technical Intern Training Act, that range of job categories, etc. is deemed to be the range of job categories, etc. notified pursuant to the provisions of Article 32-12, paragraph (1) of the Employment Security Act as applied with deemed replacement of terms pursuant to the provisions of Article 27, paragraph (2) of the Technical Intern Training Act as applied mutatis mutandis in the preceding paragraph.
