The provisions of Article 179, paragraphs (1) through (3) and Article 183 of the Financial Instruments and Exchange Act as amended by the provisions of Article 1 (limited to the amending provisions set forth in Article 1, item (v) of the Supplementary Provisions; the same applies hereinafter in this Article) (hereinafter in this Article through Article 12 of the Supplementary Provisions referred to as the "item (v) New Financial Instruments and Exchange Act") apply to trial procedures in which the decision prescribed in Article 178, paragraph (1) of the item (v) New Financial Instruments and Exchange Act is made on or after the day on which the provisions set forth in that item come into effect (hereinafter in this Article through Article 12 of the Supplementary Provisions referred to as the "item (v) effective date"), and the provisions then in force continue to govern trial procedures in which the decision prescribed in Article 178, paragraph (1) of the Financial Instruments and Exchange Act prior to amendment by the provisions of Article 1 (referred to as the "item (v) Old Financial Instruments and Exchange Act" in the following Article) was made before the item (v) effective date.
第一条の規定（附則第一条第五号に掲げる改正規定に限る。以下この条において同じ。）による改正後の金融商品取引法（以下この条から附則第十二条までにおいて「第五号新金融商品取引法」という。）第百七十九条第一項から第三項まで及び第百八十三条の規定は、同号に掲げる規定の施行の日（以下この条から附則第十二条までにおいて「第五号施行日」という。）以後に第五号新金融商品取引法第百七十八条第一項に規定する決定が行われる審判手続について適用し、第五号施行日前に第一条の規定による改正前の金融商品取引法（次条において「第五号旧金融商品取引法」という。）第百七十八条第一項に規定する決定が行われた審判手続については、なお従前の例による。
