Supplementary Provisions, Article 19Transitional Measures concerning Insurance Benefits
第十九条（保険給付に関する経過措置）
With regard to insurance benefits pertaining to In-Home Service (including services equivalent thereto), Community-Based Service (including services equivalent thereto), Facility Service, Preventive Long-Term Care Service (including services equivalent thereto), Community-Based Service for Preventive Long-Term Care (including services equivalent thereto) or Home Modification under the provisions of the Long-Term Care Insurance Act prior to amendment by the provisions of Article 5 (limited to the amending provisions listed in Article 1, item (iv) of the Supplementary Provisions) (hereinafter referred to as the "item (iv) Pre-amendment Long-Term Care Insurance Act") that were provided before the date of enforcement of the provisions listed in Article 1, item (iv) of the Supplementary Provisions (hereinafter referred to as the "item (iv) Effective Date"), the provisions then in force continue to govern.
With regard to the payment of the Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, the Exceptional Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, the Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility or the Exceptional Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility pertaining to Specified Long-Term Care Service or Specified Preventive Long-Term Care Service provided under the provisions of the item (iv) Pre-amendment Long-Term Care Insurance Act before the item (iv) Effective Date, the provisions then in force continue to govern.
With regard to the collection of the whole or a part of the amount of the benefit from a person who, by deception or other wrongful act committed before the item (iv) Effective Date, received payment of the Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, the Exceptional Allowance for Long-Term Care Service to a Person Admitted to a Specified Facility, the Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility or the Exceptional Allowance for Preventive Long-Term Care Service to a Person Admitted to a Specified Facility under the provisions of the item (iv) Pre-amendment Long-Term Care Insurance Act, the provisions then in force continue to govern.
