Articles 7 to 18
The law as Ministerial Order Partially Amending the Regulation for Enforcement of the Immigration Control and Refugee Recognition Act and the Regulation for Enforcement of the Special Act on the Immigration Control of, inter alia, those who have lost Japanese Nationality pursuant to the Treaty of Peace with Japan (Ministry of Justice Order No. 20 of 2026) leaves it, with the words it changes marked.
The main text is read a page at a time, in runs of articles. The whole main text, and the supplementary provisions and appended tables this amendment changes. Those it leaves untouched are on the page for the text in force.
A notification under the provisions of Article 11, paragraph (1) of the Act must be made by submitting a copy of the written notification pursuant to the Appended Form No. 6, a photograph, and a copy of material proving that the particulars set forth in Article 8, paragraph (1), item (i) of the Act has been changed.
法第十一条第一項の規定による届出は、別記第六号様式による届出書一通、写真一葉及び法第八条第一項第一号に掲げる事項に変更を生じたことを証する資料一通を提出して行わなければならない。
In making the notification referred to in the preceding paragraph, the notifying person must present their passport (meaning the passport specified in Article 2, item (v) of the Immigration Control Act; the same applies hereinafter) and special permanent resident certificate. In this case, a special permanent resident who is unable to present their passport is to submit a document stating the reason therefor.
前項の届出に当たっては、旅券（入管法第二条第五号に定める旅券をいう。以下同じ。）及び特別永住者証明書を提示しなければならない。この場合において、旅券を提示することができない特別永住者にあっては、その理由を記載した書類一通を提出しなければならない。
The provisions of Article 1, paragraph (2) apply mutatis mutandis to the case of making a notification referred to in paragraph (1).
第一条第二項の規定は、第一項の届出の場合に準用する。
An application under the provisions of Article 12, paragraph (1) or (2) of the Act must be made by submitting a copy of the written application pursuant to the Appended Form No. 7 and a photograph.
法第十二条第一項又は第二項の規定による申請は、別記第七号様式による申請書一通及び写真一葉を提出して行わなければならない。
The provisions of paragraph (2) of the preceding Article apply mutatis mutandis to the case of filing the application referred to in the preceding paragraph.
前条第二項の規定は、前項の申請の場合に準用する。
An application under the provisions of Article 13, paragraph (1) of the Act must be made by submitting a copy of the written application pursuant to the Appended Form No. 8, a photograph, and a copy of the material proving that the applicant has lost possession of their special permanent resident certificate.
法第十三条第一項の規定による申請は、別記第八号様式による申請書一通、写真一葉及び特別永住者証明書の所持を失ったことを証する資料一通を提出して行わなければならない。
In filing the application referred to in the preceding paragraph, the applicant must present their passport. In this case, a special permanent resident who is unable to present it must submit a document stating the reason therefor.
前項の申請に当たっては、旅券を提示しなければならない。この場合において、これを提示することができない特別永住者にあっては、その理由を記載した書類一通を提出しなければならない。
The provisions of Article 1, paragraph (2) apply mutatis mutandis to the case of the application referred to in paragraph (1). In this case, the term "preceding paragraph" in that paragraph is deemed to be replaced with "Article 9, paragraph (1)."
第一条第二項の規定は、第一項の申請の場合に準用する。この場合において、同項中「前項」とあるのは、「第九条第一項」と読み替えるものとする。
An application under the provisions of the first sentence of Article 14, paragraph (1), or Article 14, paragraph (3) of the Act must be made by submitting a copy of the written application pursuant to the Appended Form No. 9 and a photograph.
法第十四条第一項前段又は第三項の規定による申請は、別記第九号様式による申請書一通及び写真一葉を提出して行わなければならない。
An application under the provisions of the second sentence of Article 14, paragraph (1) of the Act must be made by submitting a copy of the written application pursuant to the Appended Form No. 10 and a photograph.
法第十四条第一項後段の規定による申請は、別記第十号様式による申請書一通及び写真一葉を提出して行わなければならない。
The provisions of Article 1, paragraph (2) and Article 7, paragraph (2) apply mutatis mutandis to the case of filing the application referred to in the preceding two paragraphs. In this case, the term "preceding paragraph" in those paragraphs is deemed to be replaced with "Article 10, paragraph (1) or (2)."
第一条第二項及び第七条第二項の規定は、前二項の申請の場合に準用する。この場合において、これらの規定中「前項」とあるのは、「第十条第一項又は第二項」と読み替えるものとする。
An order under the provisions of Article 14, paragraph (2) of the Act is to be given by issuing to the special permanent resident a written order to apply for re-issuance of a special permanent resident certificate pursuant to the Appended Form No. 11.
法第十四条第二項の規定による命令は、別記第十一号様式による特別永住者証明書再交付申請命令書を特別永住者に交付して行うものとする。
The payment of fees under the fee underprovisions of Article 14, paragraph (5) or Article 16-2, paragraph (16) of the Act is to be made by submitting a statement of payment of fees pursuant to the Appended Form No. 12 with a revenue stamp corresponding to the amount of the fee pasted on it.
法第十四条第五項又は第十六条の二第十六項の規定による手数料の納付は、別記第十二号様式による手数料納付書に、当該手数料の額に相当する収入印紙を貼って提出することによって行うものとする。
The document offor which the mayorhead of the municipalitymunicipalities (including special wards, and, in the case of for Article 252-19, paragraph (1) of the Local Autonomy Act (Act No. 67 of 1947), wards or administratively consolidated wards; the same applies in Article 1620 and Article 1721) makes a copy and sends the copy to the Commissioner of the Immigration Services Agency pursuant to the provisions of Article 5 of the Order for Enforcement of the Special Act on the Immigration Control of, Inter Alia, Those Who Have Lost Japanese Nationality Pursuant to the Treaty of Peace with Japan (Cabinet Order No. 420 of 2011; hereinafter referred to as the "Order"), is to be the passport presented pursuant to the provisions of Article 7, paragraph (2) (including as applied mutatis mutandis pursuant to Article 8, paragraph (2) and Article 10, paragraph (3)) or Article 9, paragraph (2).
日本国との平和条約に基づき日本の国籍を離脱した者等の出入国管理に関する特例法施行令（平成二十三年政令第四百二十号。以下「令」という。）第五条の規定により市町村（特別区を含むものとし、地方自治法（昭和二十二年法律第六十七号）第二百五十二条の十九第一項にあっては、区又は総合区。第十六二十条及び第十七二十一条において同じ。）の長が写しを作成し、当該写しを出入国在留管理庁長官に送付する書類は、第七条第二項（第八条第二項及び第十条第三項において準用する場合を含む。）又は第九条第二項の規定により提示された旅券とする。
The Commissioner of the Immigration Services Agency may provide information about special permanent resident certificate numbers which have expired by using the internet or other means.
出入国在留管理庁長官は、効力を失った特別永住者証明書の番号の情報をインターネットの利用その他の方法により提供することができる。
Persons Who Need to Promptly Receive Issuance of a Specified Special Permanent Resident Certificate
特定特別永住者証明書の交付を速やかに受ける必要がある者
The persons specified by Ministry of Justice Order as prescribed in Article 8, paragraph (1), item (iii) of the Order are as follows:
令第八条第一項第三号に規定する法務省令で定める者は、次に掲げる者とする。
a person who has made a notification under the provisions of Article 30-46 of the Residential Basic Book Act (Act No. 81 of 1967) (limited to a person who has not, after that notification, received issuance of a specified special permanent resident certificate and an Individual Number Card (meaning the Individual Number Card prescribed in Article 2, paragraph (7) of the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (Act No. 27 of 2013; hereinafter referred to as the "Number Use Act"); the same applies hereinafter));
住民基本台帳法（昭和四十二年法律第八十一号）第三十条の四十六の規定による届出をした者（当該届出後において特定特別永住者証明書及び個人番号カード（行政手続における特定の個人を識別するための番号の利用等に関する法律（平成二十五年法律第二十七号。以下「番号利用法」という。）第二条第七項に規定する個人番号カードをいう。以下同じ。）の交付を受けたことがない者に限る。）
a person whose Individual Number Card (including that Individual Number Card in the case where it is deemed, pursuant to the provisions of Article 18-5, paragraph (9) of the Number Use Act, to be an Individual Number Card issued pursuant to the provisions of Article 17, paragraph (1) of the Number Use Act) has become invalid pursuant to the provisions of Article 14, item (v) or (vi) of the Order for Enforcement of the Act on the Use of Numbers to Identify a Specific Individual in Administrative Procedures (Cabinet Order No. 155 of 2014; hereinafter referred to as the "Number Use Act Enforcement Order") (including, in the case of requesting a change of the entry of the residence certificate code pursuant to the provisions of Article 30-4, paragraph (1) of the Residential Basic Book Act, a person who has returned an Individual Number Card pursuant to the provisions of Article 15, paragraph (4) of the Number Use Act Enforcement Order and a person who has returned a specified special permanent resident certificate pursuant to the provisions of Article 16-3, paragraph (2) of the Act) (limited to a person who has not, after that invalidation and return, received issuance of a specified special permanent resident certificate and an Individual Number Card);
行政手続における特定の個人を識別するための番号の利用等に関する法律施行令（平成二十六年政令第百五十五号。以下「番号利用法施行令」という。）第十四条第五号又は第六号の規定により個人番号カード（番号利用法第十八条の五第九項の規定により番号利用法第十七条第一項の規定により交付された個人番号カードとみなされた場合における当該個人番号カードを含む。）が失効した者（住民基本台帳法第三十条の四第一項の規定により住民票コードの記載の変更を請求する場合に、番号利用法施行令第十五条第四項の規定により個人番号カードを返納した者及び法第十六条の三第二項の規定により特定特別永住者証明書を返納した者を含む。）（当該失効及び返納後において特定特別永住者証明書及び個人番号カードの交付を受けたことがない者に限る。）
a person whose specified special permanent resident certificate or Individual Number Card has been destroyed by fire or seriously damaged, or a person whose Individual Number Card (including that Individual Number Card in the case where it is deemed, pursuant to the provisions of Article 18-5, paragraph (9) of the Number Use Act, to be an Individual Number Card issued pursuant to the provisions of Article 17, paragraph (1) of the Number Use Act) has lost its function (limited to a person who has not, after that destruction by fire or damage and after that loss of function, received issuance of a specified special permanent resident certificate and an Individual Number Card);
特定特別永住者証明書又は個人番号カードを焼失し、若しくは著しく損傷した者又は個人番号カード（番号利用法第十八条の五第九項の規定により番号利用法第十七条第一項の規定により交付された個人番号カードとみなされた場合における当該個人番号カードを含む。）の機能が損なわれた者（当該焼失及び損傷後並びに当該機能が損なわれた後において特定特別永住者証明書及び個人番号カードの交付を受けたことがない者に限る。）
a person who holds a specified special permanent resident certificate that has no remaining space in which to enter the particulars listed in the items of Article 8, paragraph (1) of the Act, and any other person whom the Commissioner of the Immigration Services Agency finds appropriate as equivalent thereto;
法第八条第一項各号に掲げる事項を記載すべき余白がなくなった特定特別永住者証明書を所持する者その他これに準ずるものとして出入国在留管理庁長官が適当と認める者
a person who has been confined in a penal institution or a juvenile training school for the execution of a sentence, a person who has been detained in a workhouse, or a person who has been confined in a juvenile training school for the execution of a protective measure (limited to a person who has not, after release, received issuance of a specified special permanent resident certificate and an Individual Number Card).
刑の執行のため刑事施設若しくは少年院に収容されていた者、労役場に留置されていた者又は保護処分の執行のため少年院に収容されていた者（釈放後において特定特別永住者証明書及び個人番号カードの交付を受けたことがない者に限る。）
Method of Sending a Specified Special Permanent Resident Certificate
特定特別永住者証明書の送付方法
The methods specified by Ministry of Justice Order as prescribed in Article 8, paragraph (4) of the Order are as follows:
令第八条第四項に規定する法務省令で定める方法は、次に掲げる方法とする。
the method of sending by mail to be received only by the addressee in person, which is handed or delivered only to the addressee in person as provided for in the domestic postal service terms and conditions of Japan Post Co., Ltd., or by a method equivalent thereto;
日本郵便株式会社の内国郵便約款の定めるところにより名宛人本人に限り交付し、若しくは配達する本人限定受取郵便又はこれに準ずる方法により送付する方法
the method of sending, addressed to the place of residence of a person who has made a request under the provisions of Article 16-2, paragraph (4) of the Act together with an application under the provisions of paragraph (1) or (2) of that Article (hereinafter referred to as the "person making the request" in this item and the following item), by registered mail or, among the services of correspondence delivery prescribed in Article 2, paragraph (2) of the Act on Correspondence Delivery by Private Business Operators (Act No. 99 of 2002) (referred to as "correspondence delivery" in the following Article) provided by a general correspondence delivery business operator prescribed in paragraph (6) of that Article or a specified correspondence delivery business operator prescribed in paragraph (9) of that Article, a service equivalent to registered mail (referred to as "registered mail, etc." in the following item), as mail that is not to be forwarded in its handling or an item equivalent thereto (referred to as "non-forwardable mail, etc." in the following item) (limited to cases where the person making the request has informed the Commissioner of the Immigration Services Agency that the person making the request can reliably receive its issuance by that method);
法第十六条の二第一項又は第二項の規定による申請に併せて同条第四項の規定による申出をした者（以下この号及び次号において「申出者」という。）の住居地に宛てて、書留郵便又は民間事業者による信書の送達に関する法律（平成十四年法律第九十九号）第二条第六項に規定する一般信書便事業者若しくは同条第九項に規定する特定信書便事業者による同条第二項に規定する信書便（次条において「信書便」という。）の役務のうち書留郵便に準ずるもの（次号において「書留郵便等」という。）により、その取扱いにおいて転送をしない郵便物又はこれに準ずるもの（次号において「転送不要郵便物等」という。）として送付する方法（当該申出者が当該方法により確実に交付を受けることができる旨を出入国在留管理庁長官に申し出た場合に限る。）
if it is found difficult to effect the issuance by the methods listed in the preceding two items due to hospitalization or any other unavoidable reason, the method of sending, addressed to the location of the person making the request, by registered mail, etc. as non-forwardable mail, etc. (limited to cases where the person making the request has informed the Commissioner of the Immigration Services Agency that the person making the request can reliably receive its issuance by that method).
病院への入院その他のやむを得ない理由により前二号に掲げる方法により交付することが困難であると認められる場合には、申出者の所在地に宛てて、書留郵便等により、転送不要郵便物等として送付する方法（当該申出者が当該方法により確実に交付を受けることができる旨を出入国在留管理庁長官に申し出た場合に限る。）
Special Provisions on the Return of Special Permanent Resident Certificates
特別永住者証明書の返納の特則
The return of a special permanent resident certificate pursuant to the provisions of Article 16, paragraph (3) of the Act as applied with replacement of terms pursuant to Article 16-2, paragraph (15) of the Act is to be made by sending it by mail or by correspondence delivery.
法第十六条の二第十五項において読み替えて適用される法第十六条第三項の規定による特別永住者証明書の返納は、郵便又は信書便により送付する方法により行うものとする。
Return of Specified Special Permanent Resident Certificates upon Invalidation of the Function of an Individual Number Card, etc.
個人番号カードの機能の失効等に係る特定特別永住者証明書の返納
A foreign national who intends to return a specified special permanent resident certificate pursuant to the provisions of Article 17, paragraph (11) of the Number Use Act as applied by deeming it to be an Individual Number Card pursuant to the provisions of Article 18-5, paragraph (9) of the Number Use Act, or pursuant to the provisions of a Cabinet Order based on Article 47 of the Number Use Act, must appear at a regional immigration services bureau and submit the specified special permanent resident certificate, one written notification of return pursuant to the Appended Form No. 13, and one photograph (a photograph that is taken within six months before the date of return, which satisfies the requirements specified in the Appended Table I, and with the person's name written on the back).
番号利用法第十八条の五第九項の規定により個人番号カードとみなして適用する番号利用法第十七条第十一項の規定又は番号利用法第四十七条の規定に基づく政令の規定による特定特別永住者証明書の返納をしようとする外国人は、当該特定特別永住者証明書並びに別記第十三号様式による返納届出書一通及び写真（返納の日前六月以内に撮影されたもので別表第一に定める要件を満たしたものとし、かつ、裏面に氏名を記入したものとする。）一葉を地方出入国在留管理局に出頭して提出しなければならない。
In making the return referred to in the preceding paragraph, the person must present their passport. In this case, a person who is unable to present the passport must submit a document stating the reason therefor.
前項の返納に当たっては、旅券を提示しなければならない。この場合において、旅券を提示することができない者にあっては、その理由を記載した書類一通を提出しなければならない。
If the return set forth in paragraph (1) pertains to any of the following persons, the submission of a photograph is not required, notwithstanding the provisions of that paragraph:
第一項の返納が次に掲げる者に係るものであるときは、同項の規定にかかわらず、写真の提出を要しない。
a person who is under one year of age; and
一歳に満たない者
a person who is not a person who continues to fall under the category of special permanent resident.
引き続き特別永住者に該当する者でない者
Notwithstanding the provisions of paragraph (1), the foreign national is not required to personally appear to make the return set forth in that paragraph in the following cases:
第一項の返納は、次に掲げる場合には、同項の規定にかかわらず、当該外国人が自ら出頭してこれを行うことを要しない。
a case where, if the foreign national is under 16 years of age or is unable to make the return under paragraph (1) by themselves due to illness or other grounds, a relative of the foreign national (excluding a person under 16 years of age; the same applies in the following item) who lives with the foreign national makes the return on behalf of the foreign national;
当該外国人が十六歳に満たない場合又は疾病その他の事由により自ら第一項の返納をすることができない場合において、当該外国人の親族（十六歳に満たない者を除く。次号において同じ。）であって当該外国人と同居するものが当該外国人に代わって当該返納をするとき。
a case where a relative of the foreign national who lives with the foreign national makes the return under paragraph (1) on behalf of the foreign national at the request of the foreign national; and
当該外国人の親族であって当該外国人と同居するものが当該外国人の依頼により当該外国人に代わって第一項の返納をするとき。
a case where, if the foreign national is under 16 years of age or is unable to make the return under paragraph (1) by themselves due to illness or other grounds, a legal representative of the foreign national carries out the procedures pertaining to the return (excluding the case where the legal representative of the foreign national acts on behalf of the foreign national pursuant to the provisions of item (i)).
当該外国人が十六歳に満たない場合又は疾病その他の事由により自ら第一項の返納をすることができない場合において、当該外国人の法定代理人が当該返納に係る手続をするとき（当該外国人の法定代理人が第一号の規定により当該外国人に代わってするときを除く。）。
