第八章 罰則
第百六条
A person who violates the provisions of Article 98, paragraph (1) is punished by imprisonment for not more than three years or by a fine of not more than 1,000,000 yen, or both.
第九十八条第一項の規定に違反した者は、三年以下の拘禁刑若しくは百万円以下の罰金に処し、又はこれを併科する。
第百六条の二
A person who, in violation of the provisions of Article 36-3, paragraph (2), has divulged a secret relating to the creation or management of registration identification information is punished by imprisonment for not more than two years or by a fine of not more than 1,000,000 yen.
第三十六条の三第二項の規定に違反して、登録識別情報の作成又は管理に関する秘密を漏らした者は、二年以下の拘禁刑又は百万円以下の罰金に処する。
第百六条の三
A person who has obtained registration identification information for the purpose of using it in an application for registration that would cause a false record to be made in the motor vehicle registration file is punished by imprisonment for not more than two years or by a fine of not more than 500,000 yen. The same applies to a person who, knowing the circumstances, has provided that information.
自動車登録ファイルに不実の記録をさせることとなる登録の申請の用に供する目的で、登録識別情報を取得した者は、二年以下の拘禁刑又は五十万円以下の罰金に処する。情を知つて、その情報を提供した者も、同様とする。
A person who has kept, for the purpose referred to in the preceding paragraph, registration identification information that was wrongfully obtained is subject to the same punishment as under that paragraph.
第百六条の四
A person who falls under any of the following items is punished by imprisonment for not more than one year or by a fine of not more than 3,000,000 yen, or both:
次の各号のいずれかに該当する者は、一年以下の拘禁刑若しくは三百万円以下の罰金に処し、又はこれを併科する。
a person who has violated an order under the provisions of Article 63-2, paragraph (5);
第六十三条の二第五項の規定による命令に違反した者
a person who has failed to make a notification under the provisions of Article 63-3, paragraph (1) or (2), or has made a false notification;
第六十三条の三第一項又は第二項の規定による届出をせず、又は虚偽の届出をした者
a person who has failed to make a report under the provisions of Article 63-4, paragraph (1) or Article 75-6, paragraph (1), or has made a false report, or has refused, obstructed or evaded an inspection under these provisions, or has failed to make a statement in response to a question or has made a false statement.
第六十三条の四第一項若しくは第七十五条の六第一項の規定による報告をせず、若しくは虚偽の報告をし、又はこれらの規定による検査を拒み、妨げ、若しくは忌避し、若しくは質問に対し陳述をせず、若しくは虚偽の陳述をした者
第百六条の五
A person who violates the provisions of Article 98, paragraph (2) is punished by imprisonment for not more than one year or by a fine of not more than 1,000,000 yen.
第九十八条第二項の規定に違反した者は、一年以下の拘禁刑又は百万円以下の罰金に処する。
第百七条
A person who falls under any of the following items is punished by imprisonment for not more than one year or by a fine of not more than 500,000 yen, or both:
次の各号のいずれかに該当する者は、一年以下の拘禁刑若しくは五十万円以下の罰金に処し、又はこれを併科する。
a person who has received a permission or other disposition under the provisions of the proviso to Article 31, Article 34, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 73, paragraph (2)), Article 36-2, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 73, paragraph (2)), Article 60, paragraph (1), Article 62, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 63, paragraph (3) (including cases where applied mutatis mutandis pursuant to Article 71, paragraph (7)) and Article 67, paragraph (4) (including cases where applied mutatis mutandis pursuant to Article 71, paragraph (8))), Article 70, Article 71, paragraph (2) or (4), or Article 71-2, paragraph (1), by fraud or other wrongful means;
a person who has violated the provisions of Article 29, paragraph (1), Article 31, Article 94-5, paragraph (4) (including cases where applied mutatis mutandis pursuant to Article 94-5-2, paragraph (3)), or Article 94-5, paragraph (5);
第二十九条第一項、第三十一条、第九十四条の五第四項（第九十四条の五の二第三項において準用する場合を含む。）又は第九十四条の五第五項の規定に違反した者
a person who has violated the limitation of the scope of business under Article 78, paragraph (2) as applied mutatis mutandis pursuant to Article 94-2, paragraph (2);
第九十四条の二第二項において準用する第七十八条第二項の規定による業務の範囲の限定に違反した者
a person who has issued a safety standards conformity certificate or safety standards conformity mark without the certification of a motor vehicle inspector under Article 94-5, paragraph (1);
第九十四条の五第一項の規定による自動車検査員の証明がないのに保安基準適合証又は保安基準適合標章を交付した者
a person who has issued a limited safety standards conformity certificate without the certification of a motor vehicle inspector under Article 94-5-2, paragraph (1);
第九十四条の五の二第一項の規定による自動車検査員の証明がないのに限定保安基準適合証を交付した者
a person who has violated a disposition suspending the issuance of safety standards conformity certificates, safety standards conformity marks and limited safety standards conformity certificates under Article 94-8, paragraph (1);
第九十四条の八第一項の規定による保安基準適合証、保安基準適合標章及び限定保安基準適合証の交付の停止の処分に違反した者
an officer or employee of a registered information processing body or registered information provider that has violated an order suspending information processing services or information provision services under the provisions of Article 96-13 (including cases where applied mutatis mutandis pursuant to Article 96-19).
第百八条
A person who falls under any of the following items is punished by imprisonment for not more than six months or by a fine of not more than 300,000 yen:
次の各号のいずれかに該当する者は、六月以下の拘禁刑又は三十万円以下の罰金に処する。
a person who has violated the provisions of Article 4, Article 11, paragraph (5), Article 20, paragraph (1) or (2), Article 35, paragraph (6), Article 36, Article 36-2, paragraph (7) (including cases where applied mutatis mutandis pursuant to Article 73, paragraph (2)), Article 54-2, paragraph (7), Article 58, paragraph (1), Article 69, paragraph (2), or Article 99-2;
a person who has violated a disposition under the provisions of Article 54, paragraph (2) or Article 54-2, paragraph (6);
第五十四条第二項又は第五十四条の二第六項の規定による処分に違反した者
a person who has failed to make a report under the provisions of Article 54-3, paragraph (1), or has made a false report, or has refused, obstructed or evaded an inspection under the provisions of that paragraph, or has failed to make a statement in response to a question or has made a false statement.
第五十四条の三第一項の規定による報告をせず、若しくは虚偽の報告をし、又は同項の規定による検査を拒み、妨げ、若しくは忌避し、若しくは質問に対し陳述をせず、若しくは虚偽の陳述をした者
第百九条
A person who falls under any of the following items is punished by a fine of not more than 500,000 yen:
次の各号のいずれかに該当する者は、五十万円以下の罰金に処する。
a person who has violated the provisions of Article 11, paragraph (1) (including cases where applied mutatis mutandis pursuant to paragraph (2) of that Article and Article 14, paragraph (2)), Article 11, paragraph (4) or (6), Article 19, Article 20, paragraph (4), Article 54-2, paragraph (4), Article 63, paragraph (6), Article 73, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 97-3, paragraph (2)), or Article 98, paragraph (3);
a person who has failed to file an application under the provisions of Article 12, paragraph (1), Article 13, paragraph (1) or Article 15, paragraph (1), or has filed a false application;
a person who has exported without filing an application under the main clause of Article 15-2, paragraph (1), or after filing a false application;
第十五条の二第一項本文の規定による申請をせず、又は虚偽の申請をして輸出した者
a person who has engaged in the business of delivering motor vehicle registration number plates to the owner of a registered motor vehicle without receiving designation under the provisions of Article 25, paragraph (1);
a person who has violated an order under the provisions of Article 26, paragraph (2), Article 93 or Article 99-3, paragraph (7);
第二十六条第二項、第九十三条又は第九十九条の三第七項の規定による命令に違反した者
a person who has violated an order under the provisions of Article 28-2, paragraph (2) or Article 32;
第二十八条の二第二項又は第三十二条の規定による命令に違反した者
a person who has violated an order or instruction under the provisions of Article 54, paragraph (1) or Article 54-2, paragraph (1);
第五十四条第一項又は第五十四条の二第一項の規定による命令又は指示に違反した者
a person who has failed to provide information, or has provided false information, under the provisions of Article 57-2, paragraph (1);
第五十七条の二第一項の規定による情報の提供をせず、又は虚偽の情報の提供をした者
a person who has, in violation of the provisions of Article 66, paragraph (1) (including cases where applied with replacement of terms pursuant to Article 71-2, paragraph (4)), put a motor vehicle into operation without keeping a motor vehicle inspection certificate or limited motor vehicle inspection certificate, or without displaying an inspection mark;
第六十六条第一項（第七十一条の二第四項において読み替えて適用する場合を含む。）の規定に違反して、自動車検査証若しくは限定自動車検査証を備え付けず、又は検査標章を表示しないで自動車を運行の用に供した者
a person who has violated an order under the provisions of Article 75, paragraph (7), Article 75-2, paragraph (4) or Article 75-3, paragraph (5);
第七十五条第七項、第七十五条の二第四項又は第七十五条の三第五項の規定による命令に違反した者
a person who has conducted a motor vehicle specified maintenance business without obtaining certification under the provisions of Article 78, paragraph (1);
a person who has violated the limitation of the scope of business under the provisions of Article 78, paragraph (2);
第七十八条第二項の規定による業務の範囲の限定に違反した者
a person who has violated an order under the provisions of Article 92 or Article 94-3, paragraph (2);
第九十二条又は第九十四条の三第二項の規定による命令に違反した者
a person who has carried out specified modification, etc. in violation of the provisions of Article 99-3, paragraph (1) (in the case of a person who made the provision under item (ii) of that paragraph, limited to the case where, due to that violation, the person provided with it has carried out, on a motor vehicle issued with a motor vehicle inspection certificate, etc., a modification of the motor vehicle by altering the program, etc. relating to that violation); or
第九十九条の三第一項の規定に違反して、特定改造等をした者（同項第二号の規定による提供をした者にあつては、当該違反により当該提供を受けた者が自動車検査証交付済自動車等について、当該違反に係るプログラム等の改変による自動車の改造をした場合に限る。）
a person who has violated an order under the provisions of Article 99-3, paragraph (6).
第九十九条の三第六項の規定による命令に違反した者
第百十条
A person who falls under any of the following items is punished by a fine of not more than 300,000 yen:
次の各号のいずれかに該当する者は、三十万円以下の罰金に処する。
a person who has violated the provisions of Article 26, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 28-3, paragraph (2)), Article 28, paragraph (2), Article 29, paragraph (2), Article 33, Article 50, Article 63, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 71, paragraph (7)), Article 66, paragraph (5), Article 67, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 71, paragraph (8)), Article 74-5, paragraph (2), Article 74-6, paragraph (2), Article 75-4, paragraph (2) or (3), Article 76-6, paragraph (2), Article 89, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 94-9), Article 91, paragraphs (1) through (3), Article 94, paragraph (3), Article 94-4, paragraph (1), Article 94-6, Article 96 or Article 97-3, paragraph (1), or Article 40, Article 41, paragraph (1) or Article 42 as applied mutatis mutandis pursuant to Article 99;
第二十六条第一項（第二十八条の三第二項において準用する場合を含む。）、第二十八条第二項、第二十九条第二項、第三十三条、第五十条、第六十三条第二項（第七十一条第七項において準用する場合を含む。）、第六十六条第五項、第六十七条第一項（第七十一条第八項において準用する場合を含む。）、第七十四条の五第二項、第七十四条の六第二項、第七十五条の四第二項若しくは第三項、第七十六条の六第二項、第八十九条第二項（第九十四条の九において準用する場合を含む。）、第九十一条第一項から第三項まで、第九十四条第三項、第九十四条の四第一項、第九十四条の六、第九十六条、第九十七条の三第一項又は第九十九条において準用する第四十条、第四十一条第一項若しくは第四十二条の規定に違反した者
a person who has collected a fee without obtaining the authorization under the provisions of Article 27, paragraph (1);
第二十七条第一項の規定による認可を受けないで手数料を収受した者
a person who has failed to make a notification or report under the provisions of Article 16, paragraph (2), Article 30, paragraph (1), Article 52, Article 63-3, paragraph (4), Article 69-2, paragraph (1), Article 81 (including cases where applied mutatis mutandis pursuant to Article 94-9), Article 82, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 83, paragraph (2)), Article 94-4, paragraph (3), Article 96-9 (including cases where applied mutatis mutandis pursuant to Article 96-19) or Article 100, paragraph (1), or has made a false notification or report;
第十六条第二項、第三十条第一項、第五十二条、第六十三条の三第四項、第六十九条の二第一項、第八十一条（第九十四条の九において準用する場合を含む。）、第八十二条第二項（第八十三条第二項において準用する場合を含む。）、第九十四条の四第三項、第九十六条の九（第九十六条の十九において準用する場合を含む。）又は第百条第一項の規定に基づく届出若しくは報告をせず、又は虚偽の届出若しくは報告をした者
a person who has exported without making a notification under the provisions of the proviso to Article 15-2, paragraph (1), Article 16, paragraph (4) or Article 69-2, paragraph (3), or after making a false notification;
第十五条の二第一項ただし書、第十六条第四項又は第六十九条の二第三項の規定による届出をせず、又は虚偽の届出をして輸出した者
a person who has made a false entry in a certificate of transfer, etc. under the provisions of Article 33, paragraph (1), Article 91, paragraph (1) or Article 94-6, paragraph (1);
第三十三条第一項、第九十一条第一項又は第九十四条の六第一項の規定による譲渡証明書等に虚偽の記載をした者
a person who has violated the provisions of an order based on the provisions of Article 39, Article 76 and Article 97-3, paragraph (3);
第三十九条、第七十六条及び第九十七条の三第三項の規定に基づく命令の規定に違反した者
a person who has violated an order under the provisions of Article 29, paragraph (3), Article 53, Article 67, paragraph (3) (including cases where applied mutatis mutandis pursuant to Article 71, paragraph (8)) or Article 94-4, paragraph (4);
第二十九条第三項、第五十三条、第六十七条第三項（第七十一条第八項において準用する場合を含む。）又は第九十四条の四第四項の規定による命令に違反した者
a person who has refused, obstructed or evaded an inspection under the provisions of Article 76-40, paragraph (1);
第七十六条の四十第一項の規定による検査を拒み、妨げ、又は忌避した者
a person who has refused, obstructed or evaded an inspection under the provisions of Article 100, paragraph (2), or has failed to make a statement in response to a question or has made a false statement;
第百条第二項の規定による検査を拒み、妨げ、若しくは忌避し、又は質問に対し陳述をせず、若しくは虚偽の陳述をした者
a person who has, in violation of the provisions of Article 96-14 (including cases where applied mutatis mutandis pursuant to Article 96-19), failed to keep books, failed to make entries in books, made false entries in books, or failed to preserve books.
If a report under the provisions of Article 76-40, paragraph (1) is not made or a false report is made, the officer or employee of the Organization who committed that violation is punished by a fine of not more than 200,000 yen.
第七十六条の四十第一項の規定による報告をせず、又は虚偽の報告をした場合には、その違反行為をした協会の役員又は職員は、二十万円以下の罰金に処する。
第百十一条
Where a representative of a juridical person, or an agent, employee or other worker of a juridical person or of a person, commits a violation of the provisions set forth in the following items with regard to the business of that juridical person or person or the road transport vehicles owned or used by that juridical person or person, in addition to punishing the offender, the fine prescribed in the respective item is imposed on that juridical person, and the fine prescribed in the respective main article is imposed on that person:
法人の代表者又は法人若しくは人の代理人、使用人その他の従業者が、その法人又は人の業務又は所有し、若しくは使用する道路運送車両に関し、次の各号に掲げる規定の違反行為をしたときは、行為者を罰するほか、その法人に対して当該各号に定める罰金刑を、その人に対して各本条の罰金刑を科する。
Article 106-4: a fine of not more than 200,000,000 yen;
第百六条の四 二億円以下の罰金刑
Article 107 through the preceding Article (excluding paragraph (1), item (viii) and paragraph (2) of that Article): the fine prescribed in the respective main article.
第百七条から前条まで（同条第一項第八号及び同条第二項を除く。） 各本条の罰金刑
第百十二条
A person who violates the provisions of Article 15-2, paragraph (4) (including cases where applied mutatis mutandis pursuant to Article 16, paragraph (6) or Article 69-2, paragraph (5)), Article 18, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 69-3), Article 27, paragraph (3), Article 28, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 28-3, paragraph (2)), the second sentence of Article 63, paragraph (4), Article 69, paragraph (1), Article 75, paragraph (4), Article 89, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 94-9) or Article 94, paragraph (2) is punished by a civil fine of not more than 300,000 yen.
In any of the following cases, the officer of the Organization who committed the violation is punished by a civil fine of not more than 300,000 yen:
次の各号のいずれかに該当する場合には、その違反行為をした協会の役員は、三十万円以下の過料に処する。
where the authorization or approval of the Minister of Land, Infrastructure, Transport and Tourism must be obtained pursuant to the provisions of Chapter V-2, and that authorization or approval has not been obtained;
第五章の二の規定により国土交通大臣の認可又は承認を受けなければならない場合において、その認可又は承認を受けなかつたとき。
where, in violation of the Cabinet Order under the provisions of Article 76-7, paragraph (1), the Organization has failed to effect registration; or
第七十六条の七第一項の規定による政令に違反して、登記することを怠つたとき。
where the Organization has conducted business other than the business prescribed in Article 76-27, paragraph (1).
第七十六条の二十七第一項に規定する業務以外の業務を行つたとき。
第百十三条
A person who, in violation of the provisions of Article 96-10, paragraph (1) (including cases where applied mutatis mutandis pursuant to Article 96-19), has failed to keep financial statements, etc., has failed to enter matters that must be entered in the financial statements, etc., or has made false entries, or who has refused, without justifiable grounds, a request under the items of Article 96-10, paragraph (2) (including cases where applied mutatis mutandis pursuant to Article 96-19), is punished by a civil fine of not more than 200,000 yen.
第九十六条の十第一項（第九十六条の十九において準用する場合を含む。）の規定に違反して財務諸表等を備えて置かず、財務諸表等に記載すべき事項を記載せず、若しくは虚偽の記載をし、又は正当な理由がないのに第九十六条の十第二項各号（第九十六条の十九において準用する場合を含む。）の規定による請求を拒んだ者は、二十万円以下の過料に処する。
