If the date of enforcement of this Act is before the date of enforcement of the Act Partially Amending the Penal Code (Act No. 67 of 2022) (referred to as the "Effective Date of the 2022 Penal Code Amendments" in this Article), with regard to the application of the provisions of Article 3536 of the New Act on Measures against Infringement of Rights, etc. Arising from the Distribution of Information through specified telecommunications during the period from the date of enforcement of this Act until the day preceding the Effective Date of the 2022 Penal Code Amendments, the term "imprisonment" in that Article is deemed to be replaced with "imprisonment with work". The same applies to the application of the provisions of that Article, on or after the Effective Date of the 2022 Penal Code Amendments, to acts committed before the Effective Date of the 2022 Penal Code Amendments.
この法律の施行の日が刑法等の一部を改正する法律（令和四年法律第六十七号）の施行の日（以下この条において「刑法施行日」という。）前である場合には、この法律の施行の日から刑法施行日の前日までの間における新法特定電気通信による情報の流通によって発生する権利侵害等への対処に関する法律第三十五六条の規定の適用については、同条中「拘禁刑」とあるのは、「懲役」とする。刑法施行日以後における刑法施行日前にした行為に対する同条の規定の適用についても、同様とする。
