A Designated Community-Based Service Provider must employ the number of employees that engage in said Designated Community-Based Service as determined by Municipal Ordinance in accordance with the standards as determined by Municipal Ordinance in each Business Office pertaining to said appointment as service provider.
指定地域密着型サービス事業者は、当該指定に係る事業所ごとに、市町村の条例で定める基準に従い市町村の条例で定める員数の当該指定地域密着型サービスに従事する従業者を有しなければならない。
In addition to the provisions in the preceding paragraph, standards concerning Facilities and Management of a Designated Community-Based Service Business are determined by Municipal Ordinance.
前項に規定するもののほか、指定地域密着型サービスの事業の設備及び運営に関する基準は、市町村の条例で定める。
A Municipality, in establishing the Municipal Ordinances referred to in the preceding two paragraphs, is to establish the matters listed in items (i) to (iv) in accordance with the standards specified by Order of the Ministry of Health, Labour and Welfare, is to establish the matters listed in item (v) using the standards specified by Order of the Ministry of Health, Labour and Welfare as the standard, and is to take into account the standards specified by Order of the Ministry of Health, Labour and Welfare for other matters.
市町村が前二項の条例を定めるに当たっては、第一号から第四号までに掲げる事項については厚生労働省令で定める基準に従い定めるものとし、第五号に掲げる事項については厚生労働省令で定める基準を標準として定めるものとし、その他の事項については厚生労働省令で定める基準を参酌するものとする。

matters concerning the operation of the business of Designated Community-Based Service that are specified by Order of the Ministry of Health, Labour and Welfare as being closely related to the appropriate use of services by Persons Requiring Long-Term Care who use or are admitted to them, appropriate treatment and ensuring of safety, and maintenance of confidentiality, etc.;
指定地域密着型サービスの事業の運営に関する事項であって、利用又は入所する要介護者のサービスの適切な利用、適切な処遇及び安全の確保並びに秘密の保持等に密接に関連するものとして厚生労働省令で定めるもの
the number of maximum users pertaining to the business of Designated Community-Based Service (excluding the business prescribed in item (iii)).

The Minister of Health, Labour and Welfare, when intending to establish the standards determined by Order of the Ministry of Health, Labour and Welfare prescribed in the preceding paragraph (limited to the part concerning the handling of Designated Community-Based Service), must hear the opinion of the Social Security Council in advance.
厚生労働大臣は、前項に規定する厚生労働省令で定める基準（指定地域密着型サービスの取扱いに関する部分に限る。）を定めようとするときは、あらかじめ社会保障審議会の意見を聴かなければならない。
A Municipality, notwithstanding the provisions of paragraph (3), with regard to the matters listed in items (i) to (iv) of the same paragraph and within the scope as determined by Order of the Ministry of Health, Labour and Welfare, may provide standards concerning employees that engage in Designated Community-Based Service in said Municipality and standards concerning Facilities and Management of a Designated Community-Based Service Business.
市町村は、第三項の規定にかかわらず、同項第一号から第四号までに掲げる事項については、厚生労働省令で定める範囲内で、当該市町村における指定地域密着型サービスに従事する従業者に関する基準及び指定地域密着型サービスの事業の設備及び運営に関する基準を定めることができる。
A Municipality, when it intends to provide standards concerning employees that engage in Designated Community-Based Service in said Municipality as set forth in the preceding paragraph and standards concerning Facilities and Management of a Designated Community-Based Service Business, must reflect the opinions of Insured Persons of Long-Term Care Insurance provided by said Municipality and take necessary measures in order to promote the use of knowledge of persons with relevant knowledge and experience.
市町村は、前項の当該市町村における指定地域密着型サービスに従事する従業者に関する基準及び指定地域密着型サービスの事業の設備及び運営に関する基準を定めようとするときは、あらかじめ、当該市町村が行う介護保険の被保険者その他の関係者の意見を反映させ、及び学識経験を有する者の知見の活用を図るために必要な措置を講じなければならない。
A Designated Community-Based Service Provider, when it provides notification of abolishment or suspension of business pursuant to the provisions of paragraph (2) of the following Article or when it declines an appointment as service provider pursuant to the provisions of Article 78-8, must provide coordination with Designated In-Home Long-Term Care Support Providers, other Designated Community-Based Service Providers, and other relevant persons, and provide other conveniences, to a person who received said Designated Community-Based Service (excluding Daily Life Long-Term Care for a Person Admitted to a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care) within one month before the date of said notification, or a person who received said Daily Life Long-Term Care for a Person Admitted to a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care on the day before the first day of the prior notice period prescribed in the same Article, and who wishes to continue to be provided with services equivalent to said Designated Community-Based Service on or after the date of said abolishment or suspension of business or the date of said decline of appointment as service provider, so that necessary In-Home Service, etc. are provided continuously.
指定地域密着型サービス事業者は、次条第二項の規定による事業の廃止若しくは休止の届出をしたとき又は第七十八条の八の規定による指定の辞退をするときは、当該届出の日前一月以内に当該指定地域密着型サービス（地域密着型介護老人福祉施設入所者生活介護を除く。）を受けていた者又は同条に規定する予告期間の開始日の前日に当該地域密着型介護老人福祉施設入所者生活介護を受けていた者であって、当該事業の廃止若しくは休止の日又は当該指定の辞退の日以後においても引き続き当該指定地域密着型サービスに相当するサービスの提供を希望する者に対し、必要な居宅サービス等が継続的に提供されるよう、指定居宅介護支援事業者、他の指定地域密着型サービス事業者その他関係者との連絡調整その他の便宜の提供を行わなければならない。
A Designated Community-Based Service Provider must respect the personality of a Person Requiring Long-Term Care, act in compliance with this Act or an Order based on this Act, and faithfully perform said duty for a Person Requiring Long-Term Care.
指定地域密着型サービス事業者は、要介護者の人格を尊重するとともに、この法律又はこの法律に基づく命令を遵守し、要介護者のため忠実にその職務を遂行しなければならない。
