Supplementary Provisions, Article 21
第二十一条
Until the Municipal Ordinance prescribed in Article 78-2, paragraph (4), item (i) and Article 78-4, paragraphs (1) and (2) of the item (vi) New Long-Term Care Insurance Act (limited to the part pertaining to Community-Based Outpatient Day Long-Term Care) is enacted and put into effect within a period not exceeding one year counting from the item (vi) Effective Date, the standards specified by Order of the Ministry of Health, Labour and Welfare as prescribed in Article 78-2, paragraph (5) and Article 78-4, paragraph (3) of the item (vi) New Long-Term Care Insurance Act are deemed to be the standards provided for by the Municipal Ordinance of the Municipality concerned.
第六号施行日から起算して一年を超えない期間内において第六号新介護保険法第七十八条の二第四項第一号並びに第七十八条の四第一項及び第二項に規定する市町村の条例（地域密着型通所介護に係る部分に限る。）が制定施行されるまでの間は、第六号新介護保険法第七十八条の二第五項及び第七十八条の四第三項に規定する厚生労働省令で定める基準をもって、当該市町村の条例で定められた基準とみなす。
