Supplementary Provisions, Article 6Transitional Measures Concerning Notification of Abolition or Suspension
第六条（廃止又は休止の届出に関する経過措置）
The provisions of Article 75, paragraph (2), Article 78-5, paragraph (2), Article 82, paragraph (2), Article 99, paragraph (2), Article 115-5, paragraph (2), Article 115-15, paragraph (2) or Article 115-25, paragraph (2) of the New Long-Term Care Insurance Act apply to a Designated In-Home Service Provider, a Designated Community-Based Service Provider (excluding a person that provides Daily Life Long-Term Care for a Person Admitted to a Community-Based Facility for the Elderly Covered by Public Aid Requiring Long-Term Care; the same applies hereinafter in this Article), a Designated In-Home Long-Term Care Support Provider, a Designated Provider of Preventive Long-Term Care Service, a Designated Provider of Community-Based Service for Preventive Long-Term Care or a Designated Preventive Long-Term Care Support Provider that abolishes or suspends its business on or after the date on which one month has elapsed, counting from the Effective Date, or to the Establisher of a Long-Term Care Health Facility who abolishes or suspends said Long-Term Care Health Facility on or after that date, and the provisions then in force continue to govern a Designated In-Home Service Provider, a Designated Community-Based Service Provider, a Designated In-Home Long-Term Care Support Provider, a Designated Provider of Preventive Long-Term Care Service, a Designated Provider of Community-Based Service for Preventive Long-Term Care or a Designated Preventive Long-Term Care Support Provider that abolished or suspended its business before that date, or the Establisher of a Long-Term Care Health Facility who abolished or suspended said Long-Term Care Health Facility before that date.
新介護保険法第七十五条第二項、第七十八条の五第二項、第八十二条第二項、第九十九条第二項、第百十五条の五第二項、第百十五条の十五第二項又は第百十五条の二十五第二項の規定は、施行日から起算して一月を経過する日以後にその事業を廃止し、若しくは休止する指定居宅サービス事業者、指定地域密着型サービス事業者（地域密着型介護老人福祉施設入所者生活介護を行う者を除く。以下この条において同じ。）、指定居宅介護支援事業者、指定介護予防サービス事業者、指定地域密着型介護予防サービス事業者若しくは指定介護予防支援事業者又は同日以後に介護老人保健施設を廃止し、若しくは休止した当該介護老人保健施設の開設者について適用し、同日前にその事業を廃止し、若しくは休止した指定居宅サービス事業者、指定地域密着型サービス事業者、指定居宅介護支援事業者、指定介護予防サービス事業者、指定地域密着型介護予防サービス事業者若しくは指定介護予防支援事業者又は同日前に当該介護老人保健施設を廃止し、若しくは休止した介護老人保健施設の開設者については、なお従前の例による。
