Supplementary Provisions, Article 41, paragraph (1)

第一項

In light of the importance for an accused or a suspect (hereinafter referred to as the "accused, etc.") of receiving the assistance of counsel or of a person who intends to become counsel at the request of a person entitled to appoint counsel (in the case of a person who is not an attorney, limited to after the permission set forth in Article 31, paragraph (2) of the Code of Criminal Procedure has been granted) (hereinafter referred to as "counsel, etc."), the Government is to promote the necessary efforts concerning operational measures to enable communication by the transmission and reception of video and audio between an accused, etc. who is in physical custody and counsel, etc., in addition to interviews under the provisions of Article 39, paragraph (1) of the same Code, taking into account regional circumstances, giving consideration to ensuring confidentiality between the accused, etc. and counsel, etc., and making every effort to prevent misconduct and other such acts.

政府は、被告人又は被疑者(以下「被告人等」という。)にとって、弁護人又は弁護人を選任することができる者の依頼により弁護人となろうとする者(弁護士でない者にあっては、刑事訴訟法第三十一条第二項の許可があった後に限る。)(以下「弁護人等」という。)の援助を受けることが重要であることに鑑み、同法第三十九条第一項の規定による接見のほかに、身体の拘束を受けている被告人等弁護人等との間における映像と音声の送受信による通話を可能とするための運用上の措置について、地域の実情を踏まえ、被告人等と弁護人等との間の秘密の確保に配慮するとともに不正行為等の防止に万全を期しつつ、必要な取組を推進するものとする。
