**第一項**  法第六十一条の八の三第二項若しくは第三項（これらの規定を法第十九条の十五の二第十項において準用する場合を含む。）若しくは法第六十一条の八の三第四項の規定により中長期在留者に代わって特定在留カードの受領をする者又は出入国管理及び難民認定法施行規則（昭和五十六年法務省令第五十四号）第五十九条の四第二項第一号若しくは第二号、第三項各号若しくは第四項第一号から第三号までの規定により中長期在留者に代わって特定在留カードの受領に係る手続を行う者（以下この条において「代理人等」という。）は、出入国在留管理庁長官等（行政手続における特定の個人を識別するための番号の利用等に関する法律施行規則（平成二十六年内閣府・総務省令第三号。以下「番号利用法施行規則」という。）第四条の二第一号に規定する出入国在留管理庁長官等をいう。以下この条において同じ。）に対し、次に掲げる書類を提示しなければならない。ただし、当該代理人等が当該中長期在留者の法定代理人である場合（出入国在留管理庁長官等が必要と認める場合を除く。）は第二号に掲げる書類、出入国在留管理庁長官等が、当該代理人等から番号利用法第二条第八項に規定するカード代替電磁的記録を構成する電磁的記録のうち氏名、住所又は生年月日及び本人の写真に関する電磁的記録の送信（番号利用法第十八条の三第一項の規定による認定を受けたプログラム（情報処理の促進に関する法律（昭和四十五年法律第九十号）第二条第二項に規定するプログラムをいう。以下この条において同じ。）と同等の機能を有するものを用いて行うものに限る。）を受けるとともに、当該電磁的記録が当該送信を行った者のものであることの確認（番号利用法第十八条の四第一項の規定により内閣総理大臣が提供するプログラムと同等の機能を有するものを用いて行うものに限る。）を行った場合は第四号に掲げる書類は、それぞれ、提示することを要しない。
