### 第一条（施行期日） — Effective Date

**第一項**  この法律は、公布の日から起算して六月を超えない範囲内において政令で定める日から施行する。ただし、次の各号に掲げる規定は、当該各号に定める日から施行する。

This Act comes into effect as of the date specified by Cabinet Order within a period not exceeding six months from the date of promulgation; provided, however, that provisions set forth in the following items come into effect on the date prescribed in each item:

**第一項**  政府は、この法律の施行後三年を目途として、経済社会情勢の変化を勘案しつつ、この法律による改正後の規定の施行の状況について検討を加え、その結果に基づいて必要な措置を講ずるものとする。

**第一項**  第三条の規定による改正前の中小企業等経営強化法（以下この条において「旧中小強化法」という。）第十三条第一項の認定（旧中小強化法第十四条第一項の変更の認定を含む。）を受けた経営力向上計画は、第三条の規定による改正後の中小企業等経営強化法（次項及び第三項において「新中小強化法」という。）第十三条第一項の認定を受けた経営力向上計画とみなす。

A management capacity improvement plan that has been certified under Article 13, paragraph (1) of the Act on Strengthening the Management of Small and Medium-Sized Enterprises, etc. prior to its amendment by the provisions of Article 3 (hereinafter referred to in this Article as the "Former SME Management Strengthening Act") (including certification of a change under Article 14, paragraph (1) of the Former SME Management Strengthening Act) is deemed to be a management capacity improvement plan that has been certified under Article 13, paragraph (1) of the Act on Strengthening the Management of Small and Medium-Sized Enterprises, etc. as amended by the provisions of Article 3 (referred to as the "New SME Management Strengthening Act" in the following paragraph and paragraph (3)).

**第二項**  この法律の施行の際現に旧中小強化法第二十一条第一項の認定を受けている者の当該認定に係る施行後最初の更新については、新中小強化法第二十八条第一項中「五年ごと」とあるのは、「産業競争力強化法等の一部を改正する法律（平成三十年法律第二十六号）の施行の日から起算して五年を経過する日までの間において政令で定める期間を経過する日まで」とする。

With regard to the first renewal after this Act comes into effect of the certification of a person who actually holds, at the time this Act comes into effect, certification under Article 21, paragraph (1) of the Former SME Management Strengthening Act, the phrase "every five years" in Article 28, paragraph (1) of the New SME Management Strengthening Act is deemed to be replaced with "until the day on which the period specified by Cabinet Order has elapsed within the period up to the day on which five years have elapsed from the date on which the Act Partially Amending the Act on Strengthening Industrial Competitiveness, etc. (Act No. 26 of 2018) comes into effect".

**第三項**  この法律の施行の際現に旧中小強化法第二十一条第一項又は第二十六条第一項の認定を受けている者に対する新中小強化法第三十一条（新中小強化法第三十七条において準用する場合を含む。）の規定による認定の取消しに関しては、この法律の施行前に生じた事由については、なお従前の例による。

With regard to the rescission of certification under Article 31 of the New SME Management Strengthening Act (including as applied mutatis mutandis pursuant to Article 37 of the New SME Management Strengthening Act) of a person who actually holds, at the time this Act comes into effect, certification under Article 21, paragraph (1) or Article 26, paragraph (1) of the Former SME Management Strengthening Act, the provisions then in force continue to govern with respect to grounds that arose before this Act comes into effect.

### 第十六条（罰則に関する経過措置） — Transitional Measures Concerning Penal Provisions

**第一項**  この法律（附則第一条第二号に掲げる規定にあっては、当該規定。以下この条において同じ。）の施行前にした行為並びにこの附則の規定によりなお従前の例によることとされる場合及びなおその効力を有することとされる場合におけるこの法律の施行後にした行為に対する罰則の適用については、なお従前の例による。
