**第一項** 検察官は、第十八条第一項及び前条第一項の申出に係る電磁的記録が対象電磁的記録であるか否かを判断するため必要があると認めるときは、当該申出をした者に対し、期間を定めて、当該申出に係る電磁的記録が対象電磁的記録ではないことの裏付けとなる合理的な根拠を示す資料の提出を求めることができる。この場合において、当該申出をした者が当該資料を提出しないときは、第十八条第一項及び前条第一項の規定の適用については、当該申出に係る電磁的記録は対象電磁的記録とみなす。
