### 第百条の二（再試験） — (Retesting)

  **第一項**  公安委員会は、準中型免許、普通免許、大型二輪免許、普通二輪免許又は原付免許を受けた者で、当該免許を受けた日から当該免許を受けていた期間（当該免許の効力が停止されていた期間を除く。）が通算して一年に達することとなる日までの間（以下「初心運転者期間」という。）に当該免許に係る免許自動車等の運転に関しこの法律若しくはこの法律に基づく命令の規定又はこの法律の規定に基づく処分に違反する行為をし、当該行為が当該免許について政令で定める基準に該当することとなつたもの（以下「基準該当初心運転者」という。）に対し、その者が当該免許に係る免許自動車等を安全に運転するために必要な能力を現に有するかどうかを確認するための試験（以下「再試験」という。）を行うものとする。ただし、次に掲げる者については、この限りでない。

  A person holding an S-MVL, SM-MVL, S-ML, L-ML, or MBL who, during the period (not counting any period during which the person's license is suspended) running from the date on which the person is licensed until the date that marks the passage of one year, in total, that the person has been licensed (hereinafter referred to as the "period during which the person is a novice driver"), engages in conduct that violates this Act, an order under this Act, or a measure under this Act when driving a vehicle that the person is licensed to drive with that license, and the violation falls under the criteria that Cabinet Order prescribes with respect to the person's license (hereinafter such a person is referred to as "target novice driver"), a public safety commission is to administer testing to check whether the target novice driver has the ability to safely drive vehicles the person is licensed to drive with that license (hereinafter referred to as "retesting"); provided, however, that this does not apply to the following persons:

    **一**  当該免許を受けた日前六月以内に当該免許に係る上位免許を受けていたことがある者

    **二**  当該免許を受けた日前六月以内に当該免許と同一の種類の免許（当該免許と同等の免許として政令で定めるものを含み、第百四条の二の二第一項、第二項又は第四項の規定により取り消された免許及びこれに準ずるものとして政令で定める免許を除く。）を受けていたことがあり、かつ、その免許を受けていた期間（その免許の効力が停止されていた期間を除く。）が通算して一年以上である者

    **五**  当該免許が準中型免許である場合において、普通免許を現に受けており、かつ、当該準中型免許を受けた日前に当該普通免許を受けていた期間（当該免許の効力が停止されていた期間を除く。）が通算して二年以上である者

  **第二項**  再試験は、基準該当初心運転者の当該免許に係る初心運転者期間が経過した時におけるその者の住所地を管轄する公安委員会が、当該期間が経過した後、免許の種類ごとに自動車等の運転について必要な技能及び知識（原付免許にあつては必要な知識に限る。）について行う。

  **第四項**  公安委員会は、第一項の規定に基づき再試験を行おうとする場合には、内閣府令で定めるところにより、基準該当初心運転者の当該免許に係る初心運転者期間が経過した後速やかに、再試験を行う旨及びその理由その他必要な事項を基準該当初心運転者に書面で通知しなければならない。

  **第五項**  基準該当初心運転者は、公安委員会から再試験の通知（前項の規定による通知をいう。以下同じ。）を受けたときは、当該通知を受けた日の翌日から起算した期間（再試験を受けないことについて政令で定めるやむを得ない理由のある者にあつては、当該期間から当該事情の存する期間を除いた期間）が通算して一月を超えることとなるまでに、当該公安委員会に内閣府令で定める再試験受験申込書を提出して、再試験を受けなければならない。第九十五条の六第三項の規定は、この場合について準用する。

  Having received a notice of retesting from a public safety commission (meaning the notice under the preceding paragraph; the same applies hereinafter), a target novice driver must submit the written application for retesting that Cabinet Office Order prescribes to that public safety commission and undergo retesting before the period counted from the day following the date on which the person received the notice (for a person who has a compelling reason that Cabinet Order prescribes for not undergoing retesting, the period obtained by excluding from that period the period during which those circumstances exist) comes to exceed one month in total. The provisions of Article 95-6, paragraph (3) apply mutatis mutandis in such a case.
