  **第一項**  検察官を当事者とする人事訴訟において、民事訴訟法第六十一条から第六十六条までの規定によれば検察官が負担すべき訴訟費用は、国庫の負担とする。

  In personal status litigation that has the public prosecutor as a party, the court costs that the public prosecutor would be required to bear if the circumstances were governed by the provisions of Articles 61 through 66 of the Code of Civil Procedure are to be borne by the national treasury.

  **第二項**  利害関係人が民事訴訟法第四十三条第一項の申出又は前条第一項の決定により検察官を被告とする人事訴訟に参加した場合における訴訟費用の負担については、同法第六十一条から第六十六条までの規定を準用する。

  The provisions of Articles 61 through 66 of the Code of Civil Procedure apply mutatis mutandis to the bearing of court costs if an interested party, based on an application as referred to in Article 43, paragraph (1) of the Code of Civil Procedure or a ruling as referred to in paragraph (1) of the preceding Article, has intervened in personal status litigation in which the public prosecutor is named as the defendant.
