  **第一項**  訪問介護、通所介護その他厚生労働省令で定める居宅サービスに係る事業所について、児童福祉法（昭和二十二年法律第百六十四号）第二十一条の五の三第一項の指定（当該事業所により行われる居宅サービスの種類に応じて厚生労働省令で定める種類の同法第六条の二の二第一項に規定する障害児通所支援（以下「障害児通所支援」という。）に係るものに限る。）又は障害者の日常生活及び社会生活を総合的に支援するための法律（平成十七年法律第百二十三号。以下「障害者総合支援法」という。）第二十九条第一項の指定障害福祉サービス事業者の指定（当該事業所により行われる居宅サービスの種類に応じて厚生労働省令で定める種類の障害者総合支援法第五条第一項に規定する障害福祉サービス（以下「障害福祉サービス」という。）に係るものに限る。）を受けている者から当該事業所に係る第七十条第一項（第七十条の二第四項において準用する場合を含む。）の申請があった場合において、次の各号のいずれにも該当するときにおける第七十条第二項（第七十条の二第四項において準用する場合を含む。以下この項において同じ。）の規定の適用については、第七十条第二項第二号中「第七十四条第一項の」とあるのは「第七十二条の二第一項第一号の指定居宅サービスに従事する従業者に係る」と、「同項」とあるのは「同号」と、同項第三号中「第七十四条第二項」とあるのは「第七十二条の二第一項第二号」とする。ただし、申請者が、厚生労働省令で定めるところにより、別段の申出をしたときは、この限りでない。

  In the case where a person that has received designation under Article 21-5-3, paragraph (1) of the Child Welfare Act (Act No. 164 of 1947) (limited to that pertaining to day support for children with disabilities (meaning day support for children with disabilities prescribed in Article 6-2-2, paragraph (1) of that Act; the same applies hereinafter) of a type specified by Order of the Ministry of Health, Labour and Welfare according to the type of In-Home Service provided by the Business Office) or designation as a Designated Provider of welfare services for persons with disabilities under Article 29, paragraph (1) of the Act on Providing Comprehensive Support for the Daily Life and Life in Society of Persons with Disabilities (Act No. 123 of 2005; hereinafter referred to as the "Comprehensive Support for Persons with Disabilities Act") (limited to that pertaining to welfare service for persons with disabilities (meaning welfare service for persons with disabilities prescribed in Article 5, paragraph (1) of the Comprehensive Support for Persons with Disabilities Act; the same applies hereinafter) of a type specified by Order of the Ministry of Health, Labour and Welfare according to the type of In-Home Service provided by the Business Office) files the application set forth in Article 70, paragraph (1) (including the case where it applies mutatis mutandis pursuant to Article 70-2, paragraph (4)) with regard to a Business Office pertaining to Home-Visit Long-Term Care, Outpatient Day Long-Term Care or other In-Home Service specified by Order of the Ministry of Health, Labour and Welfare, and all of the following items are met, in applying the provisions of Article 70, paragraph (2) (including the case where it applies mutatis mutandis pursuant to Article 70-2, paragraph (4); the same applies hereinafter in this paragraph), the phrase "as set forth in Article 74, paragraph (1)" in item (ii) of Article 70, paragraph (2) is deemed to be replaced with "pertaining to employees that engage in Designated In-Home Service as set forth in Article 72-2, paragraph (1), item (i)", the phrase "as set forth in the same paragraph" with "as set forth in the same item", and the phrase "Article 74, paragraph (2)" in item (iii) of the same paragraph with "Article 72-2, paragraph (1), item (ii)".
