**第一項**  労働基準法（以下「法」という。）第三十八条の三第二項において準用する法第三十八条の二第三項の届出をしようとする使用者は、この省令の施行前においても、新規則様式第十三号により同項の届出をすることができる。

An employer that intends to make the notification under Article 38-2, paragraph (3) of the Labor Standards Act (hereinafter referred to as the "Act") as applied mutatis mutandis pursuant to Article 38-3, paragraph (2) of the Act may, even before this Ministerial Order comes into effect, make the notification under that paragraph using Form No. 13 of the new Rules.
