### 第七条（入国審査官の審査） — (An Examination by an Immigration Inspector)

  **第一項**  入国審査官は、前条第二項の申請があつたときは、当該外国人が次の各号（第二十六条第一項の規定により再入国の許可を受けている者又は第六十一条の二の十五第一項の規定により交付を受けた難民旅行証明書を所持している者については、第一号及び第四号）に掲げる上陸のための条件に適合しているかどうかを審査しなければならない。

    **二**  申請に係る本邦において行おうとする活動が虚偽のものでなく、別表第一の下欄に掲げる活動（二の表の高度専門職の項の下欄第二号に掲げる活動を除き、五の表の下欄に掲げる活動については、法務大臣があらかじめ告示をもつて定める活動に限る。）又は別表第二の下欄に掲げる身分若しくは地位（永住者の項の下欄に掲げる地位を除き、定住者の項の下欄に掲げる地位については、法務大臣があらかじめ告示をもつて定めるものに限る。）を有する者としての活動のいずれかに該当し、かつ、別表第一の二の表及び四の表の下欄に掲げる活動を行おうとする者については我が国の産業及び国民生活に与える影響その他の事情を勘案して法務省令で定める基準に適合すること（別表第一の二の表の特定技能の項の下欄第一号に掲げる活動を行おうとする外国人については、一号特定技能外国人支援計画が第二条の五第六項及び第七項の規定に適合するものであることを含む。）。

  **第二項**  前項の審査を受ける外国人は、同項に規定する上陸のための条件に適合していることを自ら立証しなければならない。この場合において、別表第一の二の表の高度専門職の項の下欄第一号イからハまで又は同表の特定技能の項の下欄第一号若しくは第二号に掲げる活動を行おうとする外国人は、前項第二号に掲げる条件に適合していることの立証については、次条第一項に規定する在留資格認定証明書をもつてしなければならない。

  The foreign national subject to the examination set forth in the preceding paragraph must themselves prove that they conform to the conditions for landing prescribed therein.   **第三項**  法務大臣は、第一項第二号の法務省令を定めようとするときは、あらかじめ、関係行政機関の長と協議するものとする。

  **第四項**  入国審査官は、第一項の規定にかかわらず、前条第三項各号のいずれにも該当しないと認める外国人が同項の規定による個人識別情報の提供をしないときは、第十条の規定による口頭審理を行うため、当該外国人を特別審理官に引き渡さなければならない。

  Notwithstanding the provisions of paragraph (1), if an immigration inspector acknowledges a foreign national who does not fall under any item of paragraph (3) of the preceding Article and the foreign national fails to provide personal identification information pursuant to the provisions of the same paragraph, the officer must transfer the foreign national to a special inquiry officer for conducting a hearing pursuant to the provisions of Article 10.
