### 第五十八条

**第一項**  営業者が、次の各号のいずれかに該当する場合であつて、その採取し、製造し、輸入し、加工し、若しくは販売した食品若しくは添加物又はその製造し、輸入し、若しくは販売した器具若しくは容器包装を回収するとき（次条第一項又は第二項の規定による命令を受けて回収するとき、及び食品衛生上の危害が発生するおそれがない場合として厚生労働省令・内閣府令で定めるときを除く。）は、厚生労働省令・内閣府令で定めるところにより、遅滞なく、回収に着手した旨及び回収の状況を都道府県知事に届け出なければならない。

When a business operator falls under either of the following items and recalls food or additives they have collected, produced, imported, processed or sold, or apparatus, or containers and packages they have manufactured, imported, or sold (excluding cases in which the recall is made by receiving an order under the provisions of paragraph (1) or (2) of the following Article and cases specified by Order of the Ministry of Health, Labour and Welfare and Cabinet Office Order as those unlikely to cause food sanitation hazards), they must notify a prefectural governor of the fact that they have commenced the recall and the status of the recall, pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare and Cabinet Office Order, without delay.

  when the business operator violates or is likely to violate a prohibition under the provisions of Article 9, paragraph (1) or Article 17, paragraph (1).

**第二項**  都道府県知事は、前項の規定による届出があつたときは、厚生労働省令・内閣府令で定めるところにより、当該届出に係る事項を厚生労働大臣又は内閣総理大臣に報告しなければならない。

When a notification under the provisions of the preceding paragraph has been filed, a prefectural governor must report the matters notified to the Minister of Health, Labour and Welfare or the Prime Minister pursuant to the provisions of Order of the Ministry of Health, Labour and Welfare and Cabinet Office Order.
