### 第五条の六（求人の申込み） — (Applying to Post a Job Opening)

**第一項**  公共職業安定所、特定地方公共団体及び職業紹介事業者は、求人の申込みは全て受理しなければならない。ただし、次の各号のいずれかに該当する求人の申込みは受理しないことができる。

A public employment security office, specified local public entity, or employment placement service provider must accept all applications to post job openings. However, it may reject an application falling under any of the following items:

  **五**  次に掲げるいずれかの者からの求人の申込み

    **イ**  暴力団員による不当な行為の防止等に関する法律（平成三年法律第七十七号）第二条第六号に規定する暴力団員（以下この号及び第三十二条において「暴力団員」という。）

    a member of an organized crime group as provided for in Article 2, item (vi) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991; hereinafter referred to as a "member of an organized crime group" in this item and Article 32);

    **ロ**  法人であつて、その役員（業務を執行する社員、取締役、執行役又はこれらに準ずる者をいい、相談役、顧問その他いかなる名称を有する者であるかを問わず、法人に対し業務を執行する社員、取締役、執行役又はこれらに準ずる者と同等以上の支配力を有するものと認められる者を含む。第三十二条において同じ。）のうちに暴力団員があるもの

  **六**  正当な理由なく次項の規定による求めに応じない者からの求人の申込み

  an application to post a job opening that is from a person who has failed to fulfill a request under the provisions of the following paragraph without reasonable grounds.

**第二項**  公共職業安定所、特定地方公共団体及び職業紹介事業者は、求人の申込みが前項各号に該当するかどうかを確認するため必要があると認めるときは、当該求人者に報告を求めることができる。

When finding it necessary to do so in order to check whether an application to post a job opening falls under any of the items of the preceding paragraph, a public employment security office, specified local public entity, or employment placement service provider may request a report from the job poster.

**第三項**  求人者は、前項の規定による求めがあつたときは、正当な理由がない限り、その求めに応じなければならない。

Upon receipt of a request under the provisions of the preceding paragraph, a job poster must comply with the request unless there are legitimate grounds for not doing so.
