### 第百一条の七（高年齢再就職給付金の支給申請手続） — Procedures for Application for Payment of Re-employment Benefits for the Elderly

    **第一項**  被保険者は、初めて高年齢再就職給付金の支給を受けようとするときは、再就職後の支給対象月の初日から起算して四箇月以内に、高年齢雇用継続給付受給資格確認票・（初回）高年齢雇用継続給付支給申請書に労働者名簿、賃金台帳その他の被保険者の年齢、被保険者が雇用されていることの事実、賃金の支払状況及び賃金の額を証明することができる書類を添えて、事業主を経由してその事業所の所在地を管轄する公共職業安定所の長に提出しなければならない。ただし、やむを得ない理由のため事業主を経由して当該申請書の提出を行うことが困難であるときは、事業主を経由しないで提出を行うことができる。

    An insured person who intends to receive payment of re-employment benefits for the elderly for the first time must, within four months counting from the first day of the month subject to payment after re-employment, submit, via the employer, to the Chief of the Public Employment Security Office having jurisdiction over the location of its place of business the continuous employment benefits for the elderly qualification confirmation form / (initial) written application for continuous employment benefits for the elderly, attaching a roster of workers, a wage ledger, and other documents capable of proving the insured person's age, the fact that the insured person is employed, the status of payment of wages, and the amount of wages; provided, however, that where it is difficult, for an unavoidable reason, to submit that written application via the employer, it may be submitted without going via the employer.

    The provisions of Article 101-5, paragraphs (2) through (8) and the preceding Article apply mutatis mutandis to the payment of re-employment benefits for the elderly. In this case, the phrase "the preceding paragraph" in Article 101-5, paragraph (2) is deemed to be replaced with "Article 101-7, paragraph (1)", and the phrase "the documents prescribed in that paragraph (excluding the certificate of wages on reaching age 60, etc.)" with "the documents prescribed in that paragraph"; in paragraph (4) of that Article, the phrase "the provisions of paragraph (1)" is deemed to be replaced with "the provisions of Article 101-7, paragraph (1)", the phrase "the main clause of Article 61, paragraph (1) of the Act" with "the main clause of Article 61-2, paragraph (1) of the Act", and the phrase "month subject to payment" with "month subject to payment after re-employment"; and in paragraphs (5) and (6) of that Article, the phrase "month subject to payment" is deemed to be replaced with "month subject to payment after re-employment".
